Missouri State Trooper Shot Nine Times During Traffic Stop

KANSAS CITY, Mo. (AP) - A man who recently was fired from his job at an elementary school is accused of shooting a state highway patrol trooper nine times after a traffic stop.
Trooper Brandon Brashear, 27, of Grain Valley, remained hospitalized Monday in critical but stable condition.
Authorities said Brashear was shot by the suspect early Saturday as the trooper got out of his car. The suspect then chased him into the highway median, continuing to shoot him with a 9 mm assault rifle, police said.
Tommy R. Rollins Jr., 26, of Grandview, was charged with assault on a law enforcement officer and armed criminal action and was being held without bond. He told reporters Sunday that he didn't mean to shoot Brashear.
"It was just temporary insanity. I wasn't even thinking when I did it," he said. "The society's what caused me to do what I did. Just look at the society we live in."
Jackson County Prosecutor Michael Sanders said Rollins' blame was misplaced.
"Mr. Rollins can try to blame anyone he wants to blame, but the reality is, society wasn't out there pulling that trigger," Sanders said.
The prosecutor did not elaborate further on Rollins' job woes.

Same problem - shooting from inside the car would require swinging the bulky firearm around and bringing it towards the window - an awkward and time consuming proposition for everything with a non-collapsed shoulder stock. The policeman would have an ample time to react and draw his sidearm. And IIRC, assault rifles have projectile energy >1000 ft-lbs, while even a hot 9mm round from a moderate length barrel would not produce more than 600, and normally less.
That's why I'd think the perp was using a regular 9mm pistol, and assault rifle nomenclature comes from the reporter's gross ignorance.

The perp did use a pistol, the comment was sent as a 9mm assault rifle was seen as not possible.
To a reporter - not well trained in much of anything dealing with weapons (or reality for that matter) a 9mm Colt would look just like an M-16 - a known assault rifle.
As noted in the other posts above, I agree an assault rifle would use an intermediate cartridge, be select fire, have a barrel of under 16 inches, large removable magazine and so on.

Does shooting a person nine times qualify as a hate crime?
Or are law officers excluded from consideration of that specific "crime"?

Per another article on this, link here, the trooper was wearing a vest. Referred article also described the weapon used as a 9mm handgun and not an "assault rifle". Thanks. The article you ref'd was published by the KC Star as published by the AP.
The article into the thread was published by the AP (directly?). So somewhere along the AP line, the gun morphed from a pistol to an assault rifle.
