Compromise or cop-out?

In my daily perusal of the news, I caught two items that illustrate, quite clearly, how liberals view the role of the judiciary, thus revealing, in stark terms, how critically important is the battle over the judicial filibuster. First, I read about a commencement speech at Brandeis University by the Massachusetts Supreme Judicial Court justice who authored the opinion declaring same-sex "marriage" legal in Massachusetts. Newsmax.com reported Justice Margaret Marshall said, "Our courts function as a pressure valve to defuse political and social tension."

Only Newsmax thought the commencement speech at Brandeis by a Supreme Court judge was newsworthy. You got a problem with somebody covering a speech by the most powerful person in Massachusets? Or should it go unreported?

Yes, I can definitely understand your concern. Aside from James Hirsen's Left Coast Report, NewsMax comes off like a Tin-Foil tip sheet. Otherwise, David Limbaugh nails it.

Those defending the Massachusetts law made a serious mistake in not making a Motion to Recuse Judge Marshall. She had made a speech to a homosexual bar association group before her court took up this case. She applauded their efforts to obtain the "right" to homosexual marriage in Massachusetts.

On the grounds of judicial ethics, Judge Marshall should have been disqualified from hearing this case. But once she sat on the case, her position as Chief Justice as well as her vote, dictated the outcome of the case. And it was, as Limbaugh's column notes, an instance of a judge who does not believe that a judge should be restrained by the law.

I agree with you...but NewMax.com isn't a person...it's a website. The author of the article was who reported it. The Times should have reference the author, IMHO. I hope nobody out there is quoting FreeRepublic.

WTF are you talking about? Are you sure that you are talking about WorldNutDaily and not NewsMax?

There is not one popular conspiracy theory that I believe in, but you are the first person I have ever seen that accuses Newsmax of being "Tin Foil Hat".

True, oh so true...

Democrats have done a good job getting people to believe this judicial fight is purely one of partisan political rancor. But it is much more than that for them. It's a last-ditch, desperation effort to hold on to the judiciary as a policymaking vehicle.
