"Alejandro Avila should be executed for kidnapping, sexually abusing and murdering 5-year-old Samantha Runnion, a jury concluded today.

The same eight men and four women who convicted Avila, 30, last month of the murder deliberated about six hours over two days before agreeing to recommend lethal injection for the Lake Elsinore factory worker.

Superior Court Judge William R. Froeberg has the option of accepting the jury's recommendation or sentencing Avila to life in prison without possibility of parole.

Avila was arrested three days after Samantha, a curly-haired pixie with a gap-toothed smile who loved heroes and the color pink, was snatched from in front of her mother’s Stanton condominium on July 15, 2002. Her body was found the next day, discarded alongside a trail off Ortega (74) Highway not far from Avila’s apartment in Lake Elsinore.

The jury heeded the admonition of Assistant District Attorney David Brent, who said that Avila "took away life, took away beauty" when he suffocated Samantha after sexually brutalizing her.

Brent scoffed at a plea by defense attorneys that the jury show sympathy for Avila because of the physical and sexual abuse he endured while growing up.

"Did he show any sympathy for Samantha?" Brent said.

Avila's public defender, Denise Gragg, told the panel in her final arguments last week that Avila was the product of his childhood. She said he was one of several children who were abused in a family dominated by an alcoholic and dysfunctional patriarch."

Excellent news, glad he will be punished. Perhaps he will be spending time with Scott Peterson.

Sadly, this guy will not see his punishment carried out until oh I don't know at least 12 years. That is 12 years BEFORE a lawyer will be assigned to handle his appeal.

In that time, folks can die, evidence lost or deteriorated. It is not fair to the loved ones waiting for the convicted to be punished and for the convicted who is entitled to a review and appeal of his conviction.

So let's see... California has 600+ inmates on death row. They're executing them at a rate no faster than 1.5/yr. Avila should get executed in about the year 2405.

Yup, as soon as I saw California I thought, well, he'll die shortly after Scott Peterson does. _Of natural causes_, in about 40 or 50 years.

It is sad that he will not see this punishment for a long time. It is also sad that it took so long to bring him to trial and this ultimate verdict.

Ordinarily I would agree, but child molesters/murderers have a habit of mysteriously "turning up dead" in prison...

They should have given him life in prison. With his record he wouldn't make it very long among the general population. Now he will have his private hotel room and the death penalty no where in sight.
