PHOENIX (AP) A federal prosecutor asked the Justice Department to check for possible civil rights violations by an Army reservist who held seven undocumented immigrants at gunpoint at a rural rest stop last month.
U.S. Attorney Paul Charlton said he made the request after an initial review of the case found no federal laws that applied to the case.
The Maricopa County Attorney's Office decided last week not to prosecute Sgt. Patrick Haab in the April 10 incident off Interstate 8 in Sentinel, about 60 miles north of the Mexican border.
Haab, 24, who is assigned to the 415th Civil Affairs Battalion from Kalamazoo, Mich., says he acted in self-defense. He said he drew a revolver that he was wearing legally to stop six men who were rushing him, then ordered them and a seventh man from a vehicle to lie face down on the ground.
Haab was arrested on seven counts of aggravated assault with a deadly weapon. Maricopa County Attorney Andrew Thomas decided against prosecuting Haab, based on a state law that lets a citizen make an arrest when a felony has been committed.
Charlton said Wednesday that Haab had endangered everyone involved.
``Mr. Haab's actions risked the lives of the illegal aliens he detained,'' Charlton said. ``He risked his own life, and had law enforcement officers come upon that scene not knowing what was happening, he could have risked everyone's life.''
Haab said he was not worried about federal prosecution. ``I know I was completely in the right,'' he said.

I found in my stint as an LEO US Attorneys have too much power and that tends to corrupt them into thinking they can do whatever they want all in the name of civil rights.
They can't get the guy for breaking the law or on any Constitutional issue, so they're going after him for extra-constitutional issues? Nuts!
Maybe one of these days a federal prosecutor was ask about a review of immigration law and whether or not it violates Americans' civil rights when those laws are not enforced.

People in the US illegally should NOT have the rights of American citizens. They should be in jail or deported immediately. Whose side is this guy on?
Instead, he spends his time harassing a military guy who saw a bunch of foreigners acting suspiciously during a time when the country has a war going on. Seems rather rational, even required, to me.
But apparently not to the law school graduate who wants to screw with him.

I've read where they simply don't have the time, manpower or resources to prosecute illegal alien cases. But they always seem to have enough time, manpower, and resources to prosecute the police for "civil rights" violations. Evidently they have plenty of time, manpower, and resources to prosecute ordinary law-abiding citizens too. This stinks to high heaven.

That is why I, again, state that someone needs to look at this DA a bit more closely. I strongly suspect that someone is either pressuring him to do this or he has been bought or both. As in all things that stink like rotting soiled diapers, follow the money...
Unfortunately, with federal prosecutors, this isn't always a guarantee. Some of these arrogant b@st@rds don't feel constrained to abide by what is right or even legal.

They're loose cannons, almost as bad as the current out-of-control federal judiciary.
