House Republicans say they haven't opened and don't plan any new investigations of federal judges after Terri Schiavo's death despite Majority Leader Tom DeLay's promise to examine the judiciary's conduct.
Some of the issues raised by DeLay were being examined by Judiciary Committee Chairman James Sensenbrenner, R-Wis., before the embattled Texas Republican's recent barrage against federal judges over their handling of Schiavo's case.
Sensenbrenner also has been looking for a long time at the idea of increasing Congress' oversight of judicial discipline. He told a judicial conference last year that Congress "will begin assessing whether the disciplinary authority delegated to the judiciary has been responsibly exercised and ought to continue."
A majority of Republicans think that unless it can be proven that judges did something illegal, they should be left alone, said GOP Rep. Bob Inglis of South Carolina, who also sits on the Judiciary Committee.
"I think we should be very, very careful about exercising legislative oversight of case-specific decisions in federal court, unless it rises to the level of judicial misconduct, in which case it's certainly appropriate to remove judges," Inglis said. "But I don't think that happened in this case."
Texas GOP Rep. Lamar Smith of Texas, a DeLay ally who leads the Judiciary subcommittee that handles court oversight, has not scheduled any new investigations or hearings, said a spokesman.

I just can't believe this.
The Dems were able, yet again, for the umpteen hundreth time to derail and intimidate the Republican majority.
They are all afraid, that the Dems will dig up real or imaginary dirt on them, just as they did with DeLay.
That's why it's important for the Republicans to stand together and STOP buckling under for the Dems.

Actually, I think the very real fear is a fear of change. We need to examine how far to go with congressional oversight of the judicial system.
I'm in favor of trying to leave well enough alone and getting rid of the filibuster. In time we can change the dynamic of the courts in favor of American values, rather than the liberal slant currently in force.
Oversight could very well backfire on us by deconstructing the independence of our judiciary, eventually giving minorities like the liberals even greater powers to intimidate conservatives in the majority.
I think it is that fear that will prevent congressional oversight of the judiciary.
Now, for Terri Schiavo's case, I think a comprehensive law allowing relatives of a patient to challenge the legal authority of a Guardian to ask for euthanasia and have that euthanasia granted, in a Federal Appeals court is not a bad idea. The premise is that the relatives will have to prove that the guardian is obstructing medical treatment due to a conflict of interest with the patient's recovery. This is to ensure that incapable patients are given full access to due process, and that all the questions that need to be asked regarding the patient are asked and answered fully. Some would argue that this is a violation of States' Rights, but it is not. States may legislate similar requirements into the Guardianship laws, thereby preempting the need for Federal intervention where injustice may be supported by the courts, with no avenue for appeals.

Every time the Republicans threaten to do something right, I get my hopes up, just to see them dashed over and over again.
I bet Frist will end up coming to some "compromise" with the Dems about the filibuster too, by giving up half of Bush's judicial nominees.
I feel the same way. Four months ago I was soooo proud of PRESIDENT Bush and our country. I honestly believed with the gains in both houses and the PRESIDENT, there was a chance...never mind...just too sad.
At the rate the republicans are going, there will be a bloodletting at the polls in 2006. The fools just don't learn or they think we are too stupid to dump them.

Frist HAS the votes, has Cheney publicly declaring that he will cast the tie breaking vote, if needed, and instead of acting on it, Frist is busy drafting a compromise, giving the Dems what they want!

We are getting a double whammy from the House and the Senate, Republicans retreat in front of the Dems.

What... you thought that the Congress actually passed their legislation in this case thinking that it would change anything? Every last one of them knew that Terri would be dead before any court would finish any hearing, ESPECIALLY if they started from scratch (as was mandated).
Furthermore, they are NOT gonna wade into the affairs of a state's court system after running on a "power to the states" platform. As you will recall, that "power to the states" deal has been a platform of most GOP candidates since Reagan.
And, quite frankly, they are not interested in Congressional review in a case that was upheld by every subsequent courth.
Lastly, the GOP also got elected on the basis of keeping the government (especially the Feds) out of people's lives.
Sorry to be the bearer of bad news... I will await your decision to shoot this messenger.

On a side note is there Any word on when they are going to let judge greer out of jail?Hes been in jail for contempt of congress since they issued the supenas and judge greer refused to acknowlege them right? /sarcasm
