Frist, Reid work on judge-approval deal

WASHINGTON - In private talks with Majority Leader Bill Frist, the Senate's top Democrat has indicated a willingness to allow confirmation of at least two of President Bush's seven controversial appeals court nominees, but only as part of a broader compromise requiring Republicans to abandon threats to ban judicial filibusters, officials said Monday.

At the same time he offers to clear two nominees to the 6th Circuit Court of Appeals for approval, officials said Sen. Harry Reid (news, bio, voting record), D-Nev., wants a third appointee to be replaced by an alternative who is preferred by Michigan's two Democratic senators.The officials spoke only on condition of anonymity, citing the confidential nature of the conversations between the two leaders.

Reid issued a statement during the day saying he has had numerous conversations with senators in both parties in hopes of avoiding a showdown. "As part of any resolution, the nuclear option must be off the table," the statement concluded, referring to the GOP threat of banning judicial filibusters.

Have to ask yourself what General George S. Patton would do if he found his enemy on the run? Hold up? Withdraw? Or go at them full-bore till no one was left standing to ever retaliate?

I notice that as soon as Frist indicated the GOP was going ahead with changing the rules Reid called for a compromise. I am sure Custer would have liked to compromise with the Indians as well when he found out he was going to get killed..

Exactly. The Rats know they're losing on this, we know it, when will Frist figure it out? As a man, he's a fine human being. As a leader he's a weak sister and definitely NOT presidential material. Not even any kind of leadership material.

Frist has no reason to compromise unless (a) he lacks the votes to change the rules; or (b) he really doesn't want to change the rules perhaps out of fear of what might happen when the Dums control the White House and Senate. But if a compromise is in the making, I suggest the following, which is modeled after the rules of jury selection:

Each party would have three "peremptory filibusters" (the equivalent of a peremptory challenge in jury selection) and an unlimited number of "filibusters for cause" (the equivilent of challenges for cause in jury selection) to use against all of the judicial nominees voted out of committee during a two year cycle(or four year cycle or whatever length of time they can agree upon). A "peremptory filibuster" can be used for any reason or no reason at all. A "filibuster for cause" can be used only if the nominee is unqualified to serve for reasons that have absolutely nothing to do with political affiliation, policy, or philosophy, such as a prior conviction for a felony, conduct constituting a high crime or misdemeanor, disbarment or suspension from the bar, or lack of citizenship.

For example, if 12 nominees are voted out of committee during the two year (or whatever) cycle, the opposition could filibuster any three of them for any reason they choose or for no reason at all. However, once they use up their three peremptory filibusters for the two year cycle, they can only filibuster for cause, which would rarely happen because a person with that kind of disqualifying baggage wouldn't receive a nomination or vote out of committee in the first place. Since the minority party wouldn't know who the POTUS is going to nominate, it would have to use the three peremptory filibusters sparingly out of concern that POTUS would nominate the most controversial nominees only after some or all of the peremptory filibusters have been used. On the other hand, the POTUS might want to offer the most controversial nominees first in the hopes that the minority party would use up their peremptory filibusters, leaving the door wide open for subsequent nominations. Both sides would obviously have to pick and choose their options very carefully.
