Kamala Khatun, a village woman of Sherpur district, was sentenced to life imprisonment along with her second husband eight years ago on charges of "killing and hiding the corpse" of her eight-year-old son with her first husband. She protested her innocence in the court but lost the case thanks to the circumstantial evidence produced by her first husband Julhas Miah.
The Court of Sherpur District and Sessions Judge found Kamala and Mizanur equally guilty of the crime on May 28, 1997 and threw them behind bars.
Later, she appealed to the High Court against the verdict. Kamala had a troubled marriage with Julhas Miah who used to physically assault her. In 1995, she divorced him and after six months, married her neighbour Mizanur Rahman. Julhas decided to make Kamala pay for this, hid Faruk in another district and filed a murder case against her. Then one fine morning in March, Faruk, the 'murdered' son, appeared in Sherpur town. Now aged 18, he looked for his mother and found her in the jail. Faruk, on advice from her mother, went to Sherpur Police Station and told police that his father Julhas Miah had made him "vanish" and that his mother was innocent. He said his father framed his mother to avenge her second marriage.
The law-enforcers took him to the district magistrate where Faruk gave a statement narrating the true story. He was then taken to the district and sessions judge's court. The judge reviewed Faruk's statements and asked the police to probe the matter.
Faruk then lodged a written complaint where he said 11 people including his father and uncles had plotted and sent him to another district before filing the false case against his mother. The complaint was later converted to a case against the father, Julhas Miah, and his 10 accomplices.
The police in their preliminary report found Faruk's statements apparently true and took him into safe custody.
The district judge on March 24 ordered that all the statements and report be sent to the High Court where Kamala's appeal remained pending.
The development prompted Bangladesh Legal Aid Services Trust (Blast) to take up the matter. Its lawyers launched an appeal to the High Court on behalf of Kamala and hearings took place earlier this month.
Yesterday, a High Court bench ordered authorities to free Kamala and her husband Mizanur Rahman on bail until Faruk's case against the 11 is resolved. The High Court also voided the Sherpur court's verdict.
It also ordered the Sherpur district and sessions judge to personally initiate legal action against the criminals, provided that Faruk's statement was true.
On behalf of Blast, Dr Shahdin Malik, Advocate Idrisur Rahman and Advocate Protikar Chakma moved for Kamala in the High Court.

Wow. That's some grudge! Hope they can get on with their lives now.
Guess the dad should learn from this - next time, kill the kid to make it legit.
