Rabbi, Man Wearing Swastika Trade Blows At Airport

KANSAS CITY, Mo. -- A rabbi wearing a yarmulke and a man wearing swastikas got into a fight at Kansas City International Airport Sunday evening.

According to a police report, Rabbi David Fine, 36, of Overland Park, was in the KCI terminal when he commented to Steven T. Boswell, 30, of Olathe, about a large swastika logo on his shirt and his swastika necklace.

Fine told Boswell that he should be ashamed of himself, and Boswell responded by calling the rabbi inhuman, the police report stated.

The rabbi allegedly threw a cup of coffee in Boswell's face and punched him. Boswell told police he then repeatedly punched Fine in the head.

Both men were handcuffed and charged with disorderly conduct. They refused medical attention.

The responding officer said Fine had some small bumps on his head and Boswell had coffee stains on his clothing.

Both men are scheduled to appear in court on June 22.

Sixty years ago, in Chaplinsky v. New Hampshire, the Supreme Court upheld for the first and only time a conviction for fighting words and made that doctrine a rare exception to the First Amendment's protection of free speech. Walter Chaplinsky, a member of the Jehovah's Witnesses, called a city marshal a "damned Fascist" and "a God damned racketeer." He was convicted of violating a New Hampshire law that declared, "No person shall address any offensive, derisive or annoying word to any other person who is lawfully in any street or other public place." In affirming the state court, the Supreme Court announced that the First Amendment does not protect "insulting or 'fighting' words—those which by their very utterance inflict injury or tend to incite an immediate breach of the peace."

The skinhead did more than "just" wear a swastika. I think most people missed that part, unfortunately.

Probably because it wasn't in the article originally posted. A subsequent article posted on the thread said the neo-Nazi "got in his face". I'd have to have seen it to judge whether it warranted the rabbi throwing a punch and throwing coffee on the guy.

Personally, my policy when dealing with all manner of scum, is to make sure that my own behavior is above reproach.

Whoa, Peter. Are you trying to restrict my free speech rights? Are you in favor of unfettered free speech? If I put that on a T-shirt, surely you would stand idly by and support my rights.

It's from an episode where NAMBLA holds a meeting in the town and the South Park kids response to their pleas of tolerance is that they believe in tolerance and free speech and all that gay stuff, but (bleep) NAMBLA.

I share your sentiment. It symbolizes torture and death to many people, and not just to Jews, for you jew-haters out there. Many young American soldiers of all religions lost their lives to the wearers of that "partisan symbol" during WWII.

Is "he needed an ass kicking" a valid defense??

Didn't some Supreme Court Justice say something about "fighting words" once. I'm pretty much a first Amendment absolutist, but if I ran a private airline I'd be happy to exclude passengers whose dress or conduct was offensive. While offensive might be in the eye of the beholder, wearing a swastika is clearly and overtly offensive.

What about Boswell's First Amendment rights?

This has nothing to do with the First Amendment because the 1st Amendment only applied to government restictions on free speech. I wish people would learn this very simple lesson.
