If I were in the military, I might be inclined to say that he doesn't deserve to wear that uniform, even now.

Defense lawyers making up stuff again (soldiers joking about raping Iraqi women. . .come on).
Defense lawyers have no honor. They will make up anything and say anything, just to see what sticks.
When it comes to trial, I fully expect the lawyer to prove the allegation about joking about rape. . .I want names!
