ACLU "rolling their own, and smoking their own" (Minuteman Project)

Day Seven
Thursday April 7, 2005

"...Just then, Jay comes over to get a dub of the Barton interview...he heads back to the RV, I head back to my room to edit the audio to send out to KFYI, the Clear Channel News Network and producers of various talk shows.....I end up having dinner with Jim Gilchrist at the chow hall...tonight it's spaghetti....as we sit and talk, someone brings him an envelope...inside, color pictures of the legal observers rolling their own, and smoking their own.....Just by looking at the pictures you can't tell if it's marijuana or tobacco....but, inside there's also a handwritten letter from an Arkansas couple who claim they took the pictures at one of the rallies last week in Naco and that they smelled marijuana coming from the three young legal observers...Jim hasn't decided what to do with the pictures and story.

Jay Lawrence stops by and looks at the pics...he starts laughing....Jim has to leave, he's headed out on a night patrol...Jay and I chat for a bit....he turns in early since he has to head out early tomorrow morning....I head back to the room and read a little before I go to bed...more stations to service first thing in the morning.....Have a good night!!!!

LOL, harrowup, look what Spiff posted just for you. Three photos that show the fruits of your 40 years of work with that communist front group, the ACLU. Three of the ACLU's finest (i.e., pot heads) think that the best way to stay razor sharp and stand ready for action to defend the Constitution, is to do it sitting on their butts stoned!

Harrowup in his own words...

"I have belonged to the ACLU for over 40 years..."   --harrowup

"I am also a Democrat..."   --harrowup

"I love beating up on Republicans and Libertarians and especially conservatives."   --harrowup

Sidebar: It is difficult to conceive of anything more outrageous than an unabashed admission by a freeper that he has been a life-long member and apologist for the Anti-American, communist-front group, the ACLU, and an unrepentant liberal member of the Democrat Party (the party of treason), and especially his confession that his mission is to be a troll and a disruptor.

The only boundary a dope smoker respects is the front door of his dealer.

The observers are working for the ACLU.

I've seen the picks and they have their ACLU observer shirts on

I wonder if they had read that recent study that marijuana use improves night vision...

I called the Sheriff's Office earlier and had to leave a message for Lt. Tomlinson. He just called me back.

He said that he has to have probable cause to arrest or search anyone. He said that in Arizona personal possession of or smoking marijuana is a misdemeanor only. He said that the police can only act upon a misdemeanor if it occurs in their presence. He said that because of the courts he can only search someone if he PERSONALLY has probable cause to do so based upon his own observations.

He said the pictures and the statements from the witnesses are not probable cause for him to search anyone since the police didn't witness anything.

I said that this should be reason enough for them to at least keep a closer eye on the ACLU "legal observers" for this kind of thing. He said that I could email the photos to him and he would look into it.

Do you think so? I mean, if you really think that I'm getting jerked around I will call the Sheriff. He'll take my call as he knows who I am. The Sheriff already read the riot act to his deputies the other day for their mishandling of the incident where the grandmother got run off the road (right by my house) by violent human traffickers. If Tomlinson is jerking me around I think that the Sheriff needs to know about it.

Think about it, if he knows, by see the photos, that they had possession of dope, that's his probable cause.

That's the same as seeing a person previously arrested for dope and then shaking him down. The probable cause is his prior arrest, even if he was not convicted.

Now I'm not a street cop, so I may be wrong, but I've seen allot less be used as probable cause and upheld by the courts.

If Police want to find probable cause, they will find it.

They know with ACLU volunteers they will be up to their necks in lawyers if they arrest one.

They would deny that's an issue, but it is an issue.

What's interesting is you are all sitting around talking about the legal observers, who they are, and what they do, without any real idea of these things. How many of you have actually been out to the border and actually talked to them?

I am a legal observer working with the ACLU on the border for the minutemen project, and I may be able to clear a few things up for you.

1-We do not get paid, not a single cent to any of us. We are volunteers who are giving up our time, our weekends (I was out on the border being harassed and verbally attacked by Minutemen on my 21st birthday, in the desert heat instead of celebrating) to protect the rights of all. Many of us are students who drive 7 hours to the border each weekend, our own gas money, our own food money, our own responsibilty to find places to stay. We are not playing "hooky" from class as you might like to believe. Broaden your minds, don't try to stereotype.

2-I was one of these legal observers supposedly caught "smoking marijuana." Let me just clarify this one as well-IT WAS TOBACCO. Hasn't anybody ever heard of rolling your own cigarettes? I'm a college student, I am poor, and it is radically cheaper to roll a cigarette than to buy pack. Again, before everybody starts trying to point fingers and jump to conclusions, it may help to try to go to the source and find out the real story. But thats obviously not what people are going for here.

We are college students spending our time (which, trust me, is in high demand the last few weeks of school) volunteering to defend rights. But all we're getting is verbally attacked and accusations. Makes me realize that legal observation is necessary. Because I can see first hand that rights are being infringed if suddenly all are no longer innocent before being proven guilty.

Oh, and also, in regards to other comments left. I hope somebody Does search my belongings. It would be completely unjustified, unconstitutional (no probably cause), and you would come up empty handed.

Here's another question for you to ponder-those pictures were taken at the largest minutemen rally of the project-with aggresive opponents, border patrol and the cochise county sherriff department in abundance-do you really think people would be so stupid as to blatantly light up a joint in the midst of this?

Wow. There arrogance and closed-mindedness never ceases to amaze me.

I've said my piece, and I know that only one person on this entire forum was actually there and knows the truth, and I can take heart in knowing that and knowing that I have done what I can to try to dismantle the ignorance surrounding good americans trying to defend liberties of all people.

If you choose not to listen, not to believe and to merely continue spouting off your stereotypical, childish rhetoric, feel free. I, however, refuse to stoop to that level.

I met these kids, had a chat with them. i ran out of my smokes, and they lent me their pack of rolling tobacco. so iam pretty confident that those are tobacco cigarettes, not marijuana, because I used to smoke a lot of pot in my day when i was young, and that sure didn't smell like it.

Tobacco and MJ smell really different and the folks that took the photos smelled MJ.

Sorry, I'll take their word for it.
