WASHINGTON - FBI Director Robert Mueller on Tuesday asked lawmakers to expand the bureaus ability to obtain records without first asking a judge, and he joined Attorney General Alberto Gonzales in seeking that every temporary provision of the anti-terrorism Patriot Act be renewed.
He also asked Congress to expand the FBIs administrative subpoena powers, which allow the bureau to obtain records without approval or a judge or grand jury.
"For many years, the FBI has had administrative subpoena authority for investigations of crimes ranging from drug trafficking to health care fraud to child exploitation," he stated. "Yet, when it comes to terrorism investigations, the FBI has no such authority."

If they don't see the need to secure our borders, then to hell with the Patriot Act. F'em.
so instead, lets put our faith in the judiciary - the most unaccountable and liberal branch of government. because that the choice here, people here who say "no patriot act" are simply willing to cede those same powers to the judiciary via court order. can we trust the courts? no way. I'll take my chances with the executive branch in the domestic war on terror.

Allowing law enforcement to creat it's own warrants, or do without them altogether is a terrible idea.
They might discover more of a threat to the political status quo from angry voters than from al queda.

Judge N was on FOX tonight talking about this. He called it "sneak and peek" and the FBI will "write" their own warrants which get them into any residence for any reason and take whatever they need. The kicker is that the citizen who's privacy is breached may not tell anyone about what has happened--attorneys, newpeople, etc. because , as the law is written, it would make it a crime to do so. Provisions in this act most certainly need to go away.
I've always thought there would be a second revolution some day--but I never thought it would be in my lifetime. The way things are looking these days, I just might be still around to see it yet. IMHO, the combination of the tyranny of activist judges, coupled with the illegal immigration will be the catalysts .

they are not unelected - if the patriot act becomes too onerous, we can either petition our existing legislators and executives to changes it, or vote them out. if some judge somewhere is sympathetic to AQ, and refuses to sign a warrant, and some act of terror occurs as a result, what will happen to that judge? nothing. if the Schiavo case has taught us anything, it should show us the true nature of the judiciary in the US.
