State police say a fatal shooting in an Adair County residence will be turned over to a grand jury for investigation, but an indictment would appear unlikely.
Someone broke into the residence of Ozie and Evelyn Toole, 14 miles west of Columbia at 3am Sunday.
State police say Ozie Toole confronted the intruder and shot him. The Adair County coroner says 21-year-old Stephen Penn of Columbia died at the scene.
A police report says entry was gained through a broken window. Investigators say the same residence had been entered earlier in the day when the Tooles were not home and that Penn was also a suspect in that break-in.
Police tell 27 NEWSFIRST Penn had worked for the family and was a neighbor. Penn's family members think he was trying to steal prescription drugs.

It seems Mr. Toole was justified. And I certainly support his right to have firearms and use them in self-defense.
But I know I'd be heart sick about killing one of my neighbor's kids, reprobate/drug addict or no...

But it seems like the media messed up the timeline a little; i.e., was the burglar shot at 3am, or later? Not clear to me.
Bush's fault. If we had a national prescription plan, this wouldn't have happened.

Who knows what families in the future were spared by the actions of this patriot. The more successful drug users are at attaining drugs illegally, the more embolden they become the next time they try to acquire them, till they may feel entitled to get what they want and may use more extreme measures (carry a weapon??) to get it that next time and may try to get something on the side while in the house, like the neighbors wife. A crazed drug freak broke into an acquaintance of mines house once for prescription drugs and decided while he was in there that he would take some pleasure with the acquaintance's wife. One problem... the husband was home, drew down on him with a 30-06, warned him not to move down the hall another inch. The guy (addict) didn't comply. He live 5 minuets after the slug from the deer rifle gutted him. What a shame; another valuable and potential contributing member of society eliminated. NOT...
Understand concerning doing what is necessary to defend yourself and loved ones. They are always the Number One Priority.
Just thinking about how difficult it would be to restore/live in harmony with such an issue between you and the other family if you live in the same neighborhood. (I'm assuming here they live within a fairly close distance and really know each other. Much different situation if he came from the opposite end of a huge housing development.)
