PINELLAS PARK, United States (AFP) - As a brain-damaged woman passed her 12th day without food or drink in a hospice here, Terri Schiavo's parents are planning to again petition the US Supreme Court to intervene, their lawyer said.
As a brain-damaged woman passed her 12th day without food or drink in a hospice here, Terri Schiavo's parents are planning to again petition the US Supreme Court to intervene, their lawyer said. Bob and Mary Schindler have been rebuffed by a series of courts in recent weeks and days, their latest setback came Wednesday after the 11th US Circuit Court of Appeals rejected their appeal to reopen the case into whether their daughter's feeding tube should be reinserted.
But the woman's parents appear set to continue waging their legal battle.
"I can confirm for you that we are now preparing to file an appeal with the United States Supreme Court," the Schindler's lawyer, Steve Kluth, said in a statement issued by his office.
However, the Schindlers have already been rebuffed once by the US' highest court in Washington on March 24.
Terri Schaivo's feeding tube was removed March 18, triggering an intense legal battle and a right-to-life political storm that sparked the involvement of the US Congress and US President George W. Bush.
Bush signed legislation backing a federal court review of Terri's case -- she has been in a persistent vegitative state for 15 years -- but the federal courts have so far declined to intervene on her behalf.
I think that would be an eating disorder of some kind. I wonder why she had not had a heart attack?
My gosh, your theory is so full of holes I hardly know where to start. If she was dying from her original injury, how did she live for 15 years? She is dying from lack of water and food. She can't get up and get her own food. Babies can't get their own food either so does that mean we let them die from starvation?
I don't think they can, because, literally, this law applied only to the Schindlers as they litigated for Terri.
Your post #5 was horrid.
There are issues here that would affect other people, but the law itself was only written for this one case. Bork said the Supremes never hear such cases. That it would have to be a general law before they would.
No it is not against the law to have eating disorders.
It is too bad and an unfortunate fact, that some behaviors have such tragic consequences.
Hydrating her is dangerous compared to what? Letting her dehydrate and die?
Quack, quack!
Would Terri's case be regarded as a precedent? Then it appears they are reluctant to set a precedent, fearing the possible ballooning of litigation that would result.
That is pitiful!
Pray for the Supreme Court to do the right thing, which is save Terri's life immediately, then consider the meritorious claim that she is being deprived of her due process rights under the 14th Amendment of the Constitution, as well as being entitled to a de novo trial on the facts of her actual condition and her actual wishes, not the garbage findings of the death judge in Pinellas County, Florida.
BUMP
Yes they have. It's frightening -- and outrageous.
No they dont.
I was pretty sure that there had not been some pronouncement in the last several days that the 'rumor' had solidified into fact. But then again, LOL, I am on the side of 'emotional hysterics'. ;)
I get the impression that there are those who find great amusement and perverse intellectual satisfaction in pursuing a hope of 'pushing us over the fragile edge of reason'. I and others, however, will take our cue from Terri and the Schindlers and keep on fighting the fight for life. Despite all that MS and his supporters have done, she will leave a legacy more powerful than the evil they have visited upon her.
This woman had a severe fever as a child (5 years old) and was left with severe brain damage. Her parents cared for her for 30 years until their deaths.
She was always considered in a vegetative state, as her doctor for those many years proclaimed. She moaned and grunted but rarely showed eye contact, so he said. There was never any therapy, because the doctor said it was pointless. (He is dead now also)
She was a quad but could be fed, (but was vegetative????) .ahem! until she moved to the nursing home, over 15 years ago.
At this time the doctor suggested to the Home they have a feeding tube inserted to make their job easier.
After 2 years there, they realized she actually could move her right arm a little. Then the CNAs started to feed her jello and pudding and even mashed potatoes. Soon after, they started limited physical and speech therapy.
Today, this woman still has to sit up in a hospital bed, and cannot make complete words. However, the staff at this home has made a picture book for her, and she can communicate pain, pleasure, and have simple conversations, by pointing to the pictures in the book. She understands everything you say and laughs at jokes. Although she will never be so called normal she is very happy and excited when people stop to talk to her.
Can you imagine laying there like a vegetable for 30 years of your life, and within a few years of getting help being able to laugh and communicate?
From what I understand even at home her parents kept her in a hospital bed and only visited her to feed her and change her, and take her out in the sun once and a while. They had other children and felt they deserved all their attention..because the Dr. basically told them she had no quality of life......so sad!
I'll donate a kidney...and I'll bet there are thousands of others who will do the same.
All this fear of harm is smoke and mirrors to hide behind in an attempt to rationalize the murder of an innocent Terri. A last minute CYA to later be able to say; "It was just too late...dontchaknow."
Sorry, I'll pass on the kool-aid
The Judiciary of Florida tortures the innocent MORE than the PRC. Want proof:
China: Execution of Tibetan Prisoners (photos, warning: gruesome)
I hope so - but it depends on us and our willingness to keep up the pressure on our elected reps, etc. I'm very discouraged today; I kept hoping there'd be a last minute save. And somehow, after she dies, I don't think I'm ever going to be able to feel the same way about this country again. I thought we were on the side of good, but it certainly doesn't seem that way, and letting our system be controlled by a two-bit tyrant who is obsessed with his own ego and procedural matters - sort of like the 19th century judges Dickens wrote about - makes me wonder if we've gotten to the point where we need a major overhaul. Well, I think I'll go off and say my prayers and go to bed now! That's about all I can think to do.
