"Keyes' case is flawed. The Penellas County police said that they would enforce the court order no matter what the Governor did.
Jeb Bush wanted to do something and was prepared to order it. But, as reported in the Miami Herald, "We told them that unless they had the judge with them when they came, they were not going to get in," said a source with the local police. "
I was told by a reporter at the hospice that the Miami Herald story was most likely a planted story from the governor's office. At first I didn't believe it because as far as I'm concerned it makes the Governor look like a wimp, but evidently some people want to believe that Jeb Bush was sending troops down to help Terri, but was turned back by the local police.
If this is true, and Jeb Bush actually sent troops, then he knows he has the authority, but allowed a rogue police department in Pinellas County to back the Governor down.

#20 I never did understand how Judge (sic) Greer could order the Protective Services Agency of the Executive Branch to cease and desist in the fulfillment of their legal duties regarding Terri. If that is not overstepping, I can't imagine what is.

So, can you tell us if it's just coincidence that Alan Keyes is there, bashing the Bushes etc... and the Schindlers have sold their donor lists to a direct marketing firm that includes 3 (count them 1...2...3) Alan Keyes organizations amongst it's clients?

I think what happens to Terri should have stayed a private matter. I don't think we need the POTUS, Congress and assorted political groups sticking their nose into every Americans last hours on this earth.

The decision was made to uphold current law. Any state law that directly contradicts the clear words of Article One, Section Two of the state constitution is unconstitutional on the face of it. So is any court ruling. The Executive has the duty to say so, and act accordingly.
How clearcut does Section Two have to be?
I often think that it is invisible to y'all, just like similiar provisions in the U.S. Constitution are to so many today.

The Governor does NOT HAVE THE POWER TO SUBVERT THE LAWS. Please provide the Florida law that the Gov has "the powers ... to "overrule a judicial decision" .. THERE IS NO SUCH LAW OR RULE OR ANYTHING TO SUPPORT SUCH AN IGNORNANT STATEMENT.
Judge Greer ruled by COURT ORDER - Jeb could not take Terri - WHERE IS YOUR EVIDENCE TO SUPPORT JEB COULD JUST DO WHAT HE WANTS ..??

Hugh Hewitt said Jeb Bush couldn't or wouldn't do it because the police would have fought back and it is the sort of thing that starts a civil war.
That's a bunch of cr@p and I'm saddened to hear Hugh Hewitt using it to excuse the inaction of Jeb Bush. Hugh has shown himself to be a 'party over priciple' guy, too. I'm quite disappointed in him.

Like any politician in the last 145 years in the US has upheld the Constitution of these United States or their state constitutions. Better to pander to the electorate on questionable constitutional, and Constitutional, grounds. His foremost duty is to hold the office of the executive branch of the state of Florida and stay within his limitations as outlined in that document. Perhaps Dr. Keyes could get a bill like this passed in his state if he's so concerned about it? Whichever state that happens to be at the moment? Oh, I forgot, he's not been elected to office has he?

Now .. here is Alan Keys saying the Gov has authority to subvert the laws of government agencies - that is just blatantly false. Not only is it false, its dangerous to liberty.
I have lost all respect for Mr. Keyes and I would never consider voting for him now that he has made clear that he believes a strongman triumphs over laws and the constitution.

What would stop Jeb from abusing his EXECUTIVE power for other purposes? To seize land, to incarcerate anyone he wants, to usurp the rights of ordinary citizens.... Of course, we are not talking about Jeb acting outside of the law in the first place. But your question is a good one. If Jeb used his executive power in an abusive manner, such as those you list, the Florida Constitution provides for his removal from office by the legislature, and certainly the voters would do the same if the legislature failed to act. I'm not certain if Florida citizens can recall Jeb, as has been done recently in California. Certainly these are sufficient safeguards to prevent such abuse. It seems to have worked for some time now.
