I'm not happy about that either, jpsb - but if there is no legal solution to what is happening, that is a signal that the law needs to be changed, not broken.
Once Terry dies, nothing will bring her back, and the damnage to the nation will be done. One thing is for sure, the GOP base is split, not good news for GOP in 06 or 08. Should the split be sever, Bush's poll number will drop big time (I think they are dropping already) an he will lose his ability to move his agenda. GOP up for reelection will run away from Bush hoping not to be painted by the same brush. Nothing good will come out of this and it very well might cause the GOP government to fall.
It's not a matter of breaking a "law" it's a matter of breaking an illegal court judgment which purports that the governor may not enforce the law. It's a matter of breaking out of "courtocracy." The governor does not evade accountability by doing this -- he remains accountable to the legislature which can choose to impeach and remove him from office. Or it can decline to do so.
