President Bush could not pardon his brother in this matter, because it would be a state issue, not a federal one.

The President's pardon power is NOT limited to Federal offenses.

Presidential pardons trump state laws. I know it's hard to believe but the Prez has absolute power to pardon anyone on any conviction in any court within the USA.

Well .. My question is - how can a state judge order the governor of his state to NOT UPHOLD the laws of the state ..??

We're talking the judicial branch ordering the executive branch of the same state to - in a sense - BREAK THE LAW.

If the 2 branches are "separate but equal" how can the judge ORDER the executive branch to do anything ..??

I'm very concerned about this.
