Presidential Pardon Could Neutralize Judge Greer

Legal experts say that if Florida Gov. Jeb Bush defies state judge George Greer and orders state troopers to rescue Terri Schiavo, he and any other officials who participate in such a move risk a contempt citation from Greer that could put them in jail.

But with a powerful ally in the White House, Terri Schiavo's would-be rescuers have nothing to fear from the runaway judge.

In 2001, President Clinton pardoned drug dealers, international money launderers - even FALN terrorists, who were spared in a blatant bid to win votes for his wife's Senate campaign.

The episode taught a bewildered nation that the powers of the president to pardon anyone he wishes are absolute and irrefutable.

Today, Clinton is the most popular American politician in the world and his wife is the frontrunning candidate for her party's presidential nomination. In other words, the Pardongate scandal's lasting political fallout was nil.

He even pardoned his own brother, who had been convicted of selling cocaine.

Should Gov. Bush decide to rescue Terri Schiavo by force in violation of Judge Greer's order, President Bush could do the same for his brother - along with any other officials the right-to-die judge tries to punish.

Would there be controversy? You bet. Would the Bush family's political enemies try to capitalize? Absolutely.

But a nation that forgives one president for pardoning terrorists will certainly forgive another who uses his pardon power to save a life.

Once Terri Schiavo begins to receive the treatment she's been denied for more than a decade, her condition will almost certainly improve. Nurses who have cared for her have already testified she can speak and eat without a feeding tube, in stark contradiction of Judge Greer's findings.

Terri's recovery, however minimal, would serve as powerful evidence that the Bush brothers did the right thing in coming to her rescue.

In the meantime, the nation would be spared the haunting specter of its government starving an innocent citizen to death.

Absolutely correct, then all we would have to fear would be a runaway, out of control government.

Article 2, section 2, clause 1, US Constitution:

and he shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.

To me, this power seems like it's limited to "offences against the United States", in other words, federal cases.

That is ridiculous! Jeb Bush isn't going to risk his political future...Even if her tube was reinserted she might die anyway now.

If that's the case then are George HW Bush, Barbara, Laura and the lot of them phonies? Not really the kind and caring people they are known to be? It's all fake?

OMG, when Clinton pardoned drug dealers, etc. it was WRONG. Now you want Gov Bush to defy the law and have the President pardon him. WRONG WRONG WRONG WRONG.

Well .. My question is - how can a state judge order the governor of his state to NOT UPHOLD the laws of the state ..??

We're talking the judicial branch ordering the executive branch of the same state to - in a sense - BREAK THE LAW.

If the 2 branches are "separate but equal" how can the judge ORDER the executive branch to do anything ..??

I'm very concerned about this.

I hate to tell you this, but if she dies there in his state, Jeb's political future is in real trouble. Don't forget who is at the core of his political base: evangelical Christians, and they're not going to like the results of this even if Jeb made a solid effort to help Terri. Remember this, and as a stock market trader I know this is true: In many people, emotion is more powerful than logic and emotion is going to work against Jeb if Terri starves to death in his state.

Are you aware of the new information that has arisen recently: affadavits from two nurses that Terri was abused by her "husband" while in the hospice, and the opinion of a neurologist from the Mayo Clinic that she's actually in a "minimally conscious state"?

(or are you just practicing your rhetoric?)

Pres. Bush or you or me or anyone else has NO excuse to cease working to save her life -- including kicking it upstairs.

Guess you didn't hear all the hue and cry over the past 60 years: why didn't the Germans stop Hitler? Why didn't the Pope? Lots of people were praying the entire time, too.

Presidential pardons trump state laws. I know it's hard to believe but the Prez has absolute power to pardon anyone on any conviction in any court within the USA.

That is simply not true.

I was saying this yesterday. It becomes a matter of obeying the law vs. Terri's very life.

Your response [above] is just about the most outrageous leap of logic [Do you know what that is?] that I've seen since this morning. Please explain how what Jeb Bush does could possibly make GWH and Barbara and Laura phonies. Try engaging your brain before posting!
