Michael Schiavo Files Request With the SCOTUS, USSC Refuses to Take Schiavo Case

Michael Schiavo has filed a petition with the Supreme Court asking them to stay out of the case.

The Florida legislature, after a case has been in the Court system for fifteen years and consistently adjudicated, decided to enact legislation to impact the outcome of that one specific case.

Tell me, who is interfering with whose authority?

The case was adjudicated in accordance to the very laws that this legislature enacted, and failed to change during the entire course of the case.

I guess if a Judge in California refuses to acknowledge whatever laws are soecifically enacted to save Michael Jackson from a child molestation conviction, you'll scream "judicial tyranny" as well?

To be really sure, she should put it in writing. If it's not in writing, I don't think it should be allowed. The word of a possibly (in the Schiavo case) abusive and soon to be divorced husband who might have something to gain by her death (note: I said "possibly") should not trump all else.

Terri's injuries should be termed under "suspicious circumstances" and investigated. Mr Shiavo should take a polygraph to clear himself from any wrong doing since he is the only witness.

If you "stayed" with your wife only long enough to collect malpractice $$, then entered a common-law marriage with another woman and had 2 kids, I wouldn't consider you the husband any longer. And neither should the government.

I just heard Judge Bork on Fox News being interviewed about the USSC turning down Terri's case. He said that this is happening in thousands of hospitals daily where babies are born with Downs Syndrome and failed abortions where the babies are born alive. He stated they are left in the hospital with no food or water until they die. My God where are we in this country?

One of the most explosive cases of this occurred in Christ Hospital. Jill Stanek was the nurse who blew the lid off of this in this particular hospital. They eventually found a way to fire her.

This occurred at Christ Hospital in Oak Lawn, Illinois.

It was also not necessary for the family to be there in the first place, disobeying the law.

Place blame where it goes, with the parents. Whether or not they (or you) agree with the decision you still have to abide by it.

Civil disobedience is not going to fix this problem.

What if your wife has an agreement with... say... your daughter, without you knowing, and terminates her life arbitrarily if she is suffering - without your input.

What will you do if it's not anyone else's business? Who will you turn to in order to prevent a renegade spouse from plotting behind your back?

Considering that they completely failed to follow up and haul that self-appointed God Greer in for contempt of congress, I'd say they were just grandstanding.

Just how "good" are they, if all they do is stand up, puff out their chests, make speeches, pass a (worthless) bill... and then, when evil confronts them, sit back, shrug their shoulders and go back to their Easter vacation barbeques.

The Oxford English Dictionary disagrees with you. Their entry for impact contains transitive citations (quotes, quotations, whatever) going back to the early 17th century. The intransitive impact only goes back to 1916, so far as they can tell. If you think they are in error, I'm sure they've an address on their website you can use to correct them, and they'll update it for the next edition.

The State of Florida does not recognize common law marriages, not only that, but they make it nearly impossible to divorce an individual in Terri's condition.

Get it in writing. Have it witnessed. Have it notarized. File it somewhere for safe keeping. If the time ever comes for either of you to have to make such decisions one for the other, I pray it doesn't, you will have no problems.

No we dont. We have a country based on rule of law. The Florida legislature had the opportunity to change the law yesterday afternoon and almost did. Dont blame your disappointment on the Courts. They are doing what strict constructionists do. They dont invent no law for special individuals. Blame your florida legislature.
