Michael Schiavo has filed a petition with the Supreme Court asking them to stay out of the case.
I'm sure these guys have made some mistakes, but you have to say they've done a great job. These guys are basically doing the same thing that the Bush v Gore lawyers did without the big guns AND with about 1/1000th of the resources. On top of that, they probably know they're never going to get paid for this.
What really frosts me though is to have someone like Jay Sekulow (from Pat Robertson's law school) be critical of the parents lawyers, yet not be in there offering his own legal skills. Where are the conservative lawyers on this?

My thoughts were that Terri's family would try to prevent it. If it is demonstrated that it is physically impossible for her to be talking and conscious as they have alleged; they would suffer scorn.
I'd bet good money that there are folks here who think that Rush's should be protected, but not Terri's.

I don't think he has the authority to prevent illegal actions by anyone, government or not. If the Executive acts illegally then summonses are issued. And not necessarily by him regardless of the connection here. He would have to file with the Attorney Gen. of FL I would think.
Ted Olsen told Laura that he wasn't shocked that SCOTUS didn't intervene, hopefully Laura will ask what the next move is regarding DCF and Jeb's executive powers in Florida.
1. NO wills, and certainly not a "living will". My understanding is that neither Michael, nor Terri, had a will created.
Rationale: Both Terri and Michael believed, and statistics overwhelmingly support, that they would live to an advanced age, perhaps 70+ years. There was no sense of urgency to prepare for their passing, especially at a young age.
2. NO life insurance. That is not conclusive, but can be inferred by the Schiavos' statements that Michael will reap no monetary benefit from Terri's death.
Rationale: As listed in Item 1, neither Terri, nor Michael believed they would die at a young age, hence, no urgency to prepare for either of their deaths.
3. Terri's wish. It is important to understand the context that Terri made her alleged statements, those very same statements that are used as the basis to withhold her sustenance.
Rationale: Terri was responding to the recent death of the Schiavo's mother or grandmother. This woman was: a) elderly b) terminal (dying from cancer) c) apparently, in a great deal of pain d) being kept alive by extraordinary means (respirator). In fact, I believe she died within a day of the respirator being pulled.
It was immediately following this unfortunate event that Terri indicated something similar to the fact, "that she would never want to be kept alive in that manner".
It could be argued and should have been considered that Terri's "frame of reference" was envisioning herself at an advanced age, in a condition similar to the Schiavo relative. In a similar circumstance, she would never want to be kept alive
Her capacity, and Michael's, to envision either one of them dying or becoming incapacitated at a young age, did not exist, as evidenced by actions (inaction) related to their wills and insurance. Her statements occured when she was approx. 23 or 24 years of age, and it can be argued that she could not foresee herself being in the tragic state that befell her at 26 years of age.
There should have been enough doubt about the intent of her statement to rule on the side of life.

It's not going to happen. Terri will die, people will not get outraged.. Don't you know the almighty polls are saying that the majority didn't want congress intervening and agree with Terri's "right to die." People will forget and this will just be the grand entrance of euthanasia in the U.S, without a peep from the people.

Where were the House GOP lawyers on this? They could have helped at the same time filing their own briefs, etc. The families lawyers could only do so much. They have been fighting this battle in DC, in Tallahassee, St Pete, Alanta and Tampa. Where are the pro-life lawyers on this?
What is it with this Florida stuff. Seems like the venue for the ultimate showdown between good and evil, between things Freepers live for and things that absolutely, overwhelmingly disgust them.
