Something MUST Be Done Today for Terri Schiavo (Rescue Her Today!)

I wrote this to a FReeper earlier. She was feeling much frustration with many here I believe because of what was, in her mind, a careless disregard for morality and the well-being of an innocent and quite defenseless girl, Terri Schiavo.

The intelligent and good FReeper was at the point of wanting to leave FR. So I wrote her:

Don't go, please. You're one of the folks here with a real good heart and very strong feelings. That is a very good combination. Don't go ........

I'm getting a feeling (or a wish) that today (Wednesday) the Federal marshals or some others are going to take control of this abysmal situation. Unlike the Elian Gonzalez catastrophe, this will be for the good of a human being.

Maybe in the future it can be referred to as 'Good Wednesday'. Because the more I learn about this entire case, this girl has been done wrong since the very beginning and things must be righted. What is happening now must end....... well.

I implore all who care about the wrongness of all this to contact the White House, contact anyone who could have something to do with getting action TODAY. There can not be any more wasted time and destruction of this innocent girl. If this husband is much of what we suspect, this matter should not be allowed to end in her death by these brutal means!

Done, with some editing. Nothing you wrote was removed, but my spell checker did correct the spelling of subpoena. I added a short paragraph encouraging him to pust the Congress to rein in the courts.

But the problem is not that things are getting better too slowly, the problem is that things are getting worse. A Republican majority in the house, senate and command of the white house seems to be unable to save Terri Schiavo's life. I'm very disillusioned with the Republicans and I don't want to hear about incrementalism unless it saves a life.

Generally the courts do not accept hearsay, so why are the courts using hearsay to convict Terri to death by dehydration?

Because they want to and because they can.

...adding food makes their situation worse, not better....do more harm by force-feeding them.Do some research on the complications and problems caused by tube feeding those in the process of dying...potential complications...

If someone is not eating or drinking anything and will die a painful death by thirst in a week - how can it make it "worse", do "harm", "bring complications and problems" to put in a feeding tube?

isrul, when my mother is finding it difficult to eat, and it becomes difficult and time-consuming for the kind people in the nursing home to hand feed her, then my sisters and I will feed her and offer her drink.

It is our duty to do so, as she patiently fed us and offered us her breast when we were unable to do so for ourselves. Fortunately, we will be able to do this for here, as our families are grown, and we are retired.

As you say, each case is different, and each of us must make difficult choices about the kindest care possible for our loved ones when they are dying. But, I do believe the guiding principle must be, "First Do No Harm".

The iodea of having to have my mom's tied up like a dog so she couldn't pull out her feeding tube frightens and disgusts me.

Seven of nine S.C. justices are Republican appointees. Only three of those appear, to me, to be strict constructionists. If we make the claim that the Supreme Court is safer long term, under Republican stewardship, we need to begin making good on that claim. It's an absolute outrage that someone like Kennedy or Souter got through, under our watch.

It's about time to recognize that this isn't about the impropriety of spousal rights, legal guardianship or power of attorney. This is about judicial activism that favors one party over the other on grounds other than the merits of the case, existing law and core principles that underlie all law in this land, that is, our sovereign rights as individual human beings.

The Constitutional "scholars" who have been arguing that "due process has been done over and over again" fail to recognize, whether by ignorance or intent it doesn't matter, that due process is not applied merely by going through the motions of procedure but must be manifested with the spirit of impartiality and observed by following the intent of the letter of the law not just its course.

That is why Section 1 of Amendment XIV closes with a conditional statement concerning equal application of the law. It indicates, in fact mandates, that due process must be applied without prejudice or the entire process fails Constitutional muster.

...nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

The honored legal standing of a spouse's power of attorney should not be in question here and I don't believe it has been. I would not support Congress, the President or anyone else who challenges its traditional standing.

It is time now, however, to actively answer the question raised in this case; "has Judge Greer elevated spousal right of attorney to an absolute that exceeds the individual inalienable right to life?" which is stretching that right beyond tradition or reason. The tradition I speak of is the American tradition embodied in the DoI, "we hold these truths to be self-evident", that life and liberty are the most honored rights of all. In fact they are held as sacrosanct.

If the Dems want to invoke more medieval or Mideastern traditions of spousal rights like bigamy, beating and the right to buy or sell a wife they are welcome to. That's probably not quite as repugnant as infanticide.

Let us also remember that the Jews were duly processed in Hitler's Germany. They rarely failed to follow procedure to the letter.

It seems that the courts can find no fault with the courts. Not so the Governor. The Governor of Florida has called in the Feds.

"I'm not sure we can get it done here in Florida," Martinez quoted (Gov.) Bush as saying just after a new Schiavo measure stalled in the Florida Legislature. "Do whatever you can federally."

It seems the Governor of the State has found no relief and lost confidence in the Legislature and Judiciary and has called in the Feds. It can't now be said that the Feds have no business there.

The Executive Branch wields the authority of enforcement, security and investigation, Congressional investigations aside. Congress should step aside and ask the President to handle this.

Time for Federal Marshals and agents in black shiny FBI shoes.

Kennedy was much more conservative. He changed.

Judges, like charitable foundations, can't be controlled once they've been given power. It's folly to think that appointments alone can control things. Conversely, some Democrat appointees have followed the path of Zell Miller. It's crazy.

Please do some simple research on feeding tubes in Alzheimer's patients at the end stages before solidifying your opinion on whether this is a desirable choice.

What you read may surprise you. I worry that feeding tubes are more for the convenience of the nursing home staff, and not for the comfort and well-beinf of the patient. As I said above, while I may not be able to provide all the physical care my mother might need at the end stage, sitting by her side for hours, patiently and slowly feeding her and offering her sips of water is the least I can do,

Terri's situation is so very different. She should be tube-fed until she is retrained to eat, which I do believe she could be. If she were my daughter, I would be fighting as the Schindler's are to save her life.

Good for your friend. If the President or the Gov. of FL won't act then citizens should. Civil disobediance is not a bad thing. Rosa Parks broke the law. And then the President sent in Federal Marshals and FBI agents.

Why are the Democrats currently 2 for 2 ideologically in their appointments, (and probably that consistent historically as well), and we are 3 for 7? There's a perverse sort of gentlemanly "fair game" nonsense that goes on, for example, when it came to the case of Souter. George Bush senior should have said something like "oh, you don't like Bork, do you? We'll give you Super-Bork."
