U.S. judge rejects Schiavo appeal

A federal judge refused yesterday to restore Terri Schiavo's feeding tubes, prompting the parents of the brain-damaged woman to take their case immediately to an appeals court. U.S. District Judge James Whittemore ruled against reinserting the feeding tube, which was removed Friday under a state court order pursued by Mrs. Schiavo's husband, Michael. Judge Whittemore said state courts have handled the case sufficiently. "Theresa Schiavo's life and liberty interests were adequately protected by the extensive process provided in the state courts," he said.

I wonder if Terri's parents can file a lawsuit against Michael Shaivo charging neglect or maltreatment for refusing to get Terri appropriate therapy. Once the lawsuit is filed a second request of the court could be made to keep Terri alive since she is the primary witness in the case against Michael Shaivo. The law requires that the witness be protected. It may buy time...???

Excellent thinking. Something along the lines of a Wrongful death lawsuit, as in the O.J. case.
