Mr. FRIST. I share the understanding of the Senator from Michigan, as does the junior Senator from Florida who is the chief sponsor of this bill. Nothing in the current bill or its legislative history mandates a stay. I would assume, however, the Federal court would grant a stay based on the facts of this case because Mrs. Schiavo would need to be alive in order for the court to make its determination. Nevertheless, this bill does not change current law under which a stay is discretionary.Da da da... Dats All Folks!

Gee. There was actually one human being found on that court. In the minority of course.
The Judicial Branch should be proud. They have convinced themselves of objectively ruling on the law. They can join the doctors who pride themselves on successful operations where the patient died.

It takes a lot of legal mumbo jumbo to justify starving a disabled woman to death.
People need to take note though:
None of this is FOR Terri. It is FOR those who want her dead.
They will walk away from a mountain of legal documents and say they did everything they possibly could to save Terri. When all they really had to do was feed her.

Yes, obviously the legislators intent was that Terri starve to death while the judges hear evidence and deliberate the case.
Only a judge who is looking for an excuse would try this one.

Majority opinion had one appointed by Bush Sr. (9/92) and one by Clinton (1997). Dissenter was a Clinton appointee, 1999.
