Continuation of Terri Schiavo daily March threads. Due to overwhelming participation we reached over 5000 posts in three days time!
interesting.. considering that Cohen is a criminal attorney, and Gibb's lawsuit naming Greer et al, is a CIVIL suit...hmmmmmmmm.. personally that would put up a red flag..
I'm here catching up and reading through the thread in the wee hours of the morning, and just wanted to say that I agree with what you wrote in 1576 completely.
I'm thankful for what the Congress and the President have done, but enraged that they are continuing to bow before the judicial branch. Probably most of us laypeople could see that judicial tyranny is the problem. Congress and the President and Governor Jeb Bush have not yet shown the will to deal directly with that, and that alarms me.
btw.. have you peeked in on Free Republic's very own Michael Schiavo fan club thread? I had to stop myself from posting.. it's disgusting! It's the story about how MS's friends and family think he's a wonderful guy...

Hey...I did get some sleep...about two hours...before that hearing...I did find something out...on Greta, a guy she had on talking about the case (some lawyer) said that the appeals court (11th circuit) has already overturned the FIRST injunction that David Gibbs filed on Friday to try and stop the removal of the tube. So I looked it up on google and found an article that says the 11th is holding off on the appeal until the District court rules...my thinking is that they figure if the district grants this request there won't be an appeal...so this is seeming to be good news...I posted the article above somewhere not too long ago...
Correction: in my first post to you, twice I said Greer when I meant Gibbs. I am sorry to add confusion, but I am tired like everyone. Moody of the Fl Fed. Dist. Court was overturned by Atlanta, already, after he had refused to hear Gibbs, saying he lacked Fed. jurisdiction, and Atlanta responded quickly against Moody's refusal, all of which happened back before Congress passed the new law. Gibbs has already filed with Atlanta, Awestruck. They seem favorably disposed to do something, but Whittemore refuses so far to formally rule or say when he will. Meanwhile, Terri noticeably weakens...

I just got through telling Awestruck that you said the 11th Circuit overturned Moody when he refused Gibbs back on the 18th. Is that not what you wrote? Now I read you are saying the 11th Circuit overturned or ruled against Gibbs already, then you find cause for hope in that. Afraid I am hopelessly confused(and I seldom feel that way, legaleagle).

I am thinking that because that guy said that on Greta, he knows someone that has told him it will be overturned...the reason the appellate would hold their ruling is that if Whittemore rules in our favor, no appeal is needed and the new trial for Terri would stay in Tampa
in other words, when an appellate court overturns something, it usually will remand back to the lower court for a new trial..and will only have to do so if this current court denies gibbs motions

Well it's 5:45 AM here, I have the flu bad and although Im staying home from work, Im spending my time awake and worrying about this instead of resting up !
Once more your comments are posted to yourself. Okay by me, as long as you know it. Your reasonings about hope from the 11th Circuit are probably well-founded, but what about the stall by Whittemore? He has flatout refused to hint whenever he might issue a ruling. Many, many FReepers believe he is doing so on purpose until Terry dies, or has irreversible damage. What say you?
