DeLay Pledges Contempt Charge for Terri Judge

House Majority Leader Tom DeLay pledged Friday to hold Florida state judge George Greer in contempt of Congress for ignoring a congressional subpoena for Terri Schiavo's testimony, saying, "No little judge sitting in a state district court in Florida is going to usurp the authority of Congress."
"The Congress will pursue this, if we have to hold him in contempt of Congress," DeLay told radio host Sean Hannity.
Pressed on whether he intended to hold Judge Greer in contempt, the top Republican told Hannity: "Absolutely, absolutely."
"We will do everything to enforce the power and authority of the Congress and no little judge sitting in a state district court in Florida is going to usurp the authority of Congress," he added.
Earlier in the day Judge Greer rebuffed the Schiavo subpoena, telling attorneys in the case, "I have had no cogent reason why the [congressional] committee should intervene." He claimed that the last-minute action on the part of Congress does not nullify years of legal proceedings.
But DeLay told Hannity, "This judge and the Supreme Court of Florida are well known to be liberal judges that have a different worldview and they're imposing their worldview on the law."
The top House leader said that "no sane person" could look at Schiavo and say she's in a persistent vegetative state.
DeLay called a lawyer for Michael Schiavo, who has pressed for years to have his wife starved to death, "the personification of evil."

Would you want to do away with the death penalty if it was found that one person had been wrongly executed?
Frankly, I would. If our judicial system makes such heinous mistakes, we shouldn't be allowing it to make life and death decisions.
Then why do you want our Government/Judicial System to make decisions in the Schiavo case?
Why can't you leave it to her husband as it should be?

On what legal grounds does the President send in Federal Marshalls? If he is challenged in court, and loses (which he would), what then? George Greer is attempting to kill a federal witness. I believe there are federal statutes against that sort of thing. I don't remember whether witnesses are covered under the same statutes that provide federal protection to poultry inspectors and the like, but I'm pretty sure there's a federal statute protecting them.

We have a very basic sort of decision about the extent of state sovereignty to make here, and as a practical matter we don't get to have it both ways.

I wonder how many FReepers here demanding Federal action (marshals, subpoenas, contempt, etc) were a few months ago demanding the federal courts NOT involve themselves with the Alabama 10 commandments judge? Good point. Those who are screaming for Federal intervention here were castigating Judge Thompson for ordering Roy Moore to take down his monument.
Are we a nation of laws, or not?

Well why not? The democrats are the ones who put those judges where they are in FL and on the federal bench, the democrats are holding on by their fingernails to keep those courts packed with their nominees. That's what the battle in DC is all about.

Those who fear activist judges should REALLY fear that law.

May God rescue Terri Schiavo. You were absolutely correct. These perverts want to kill innocent babies and the disabled and yet will fight to prevent the deaths of murderers and even terrorists.
