President George W. Bush and Republican senators should learn from Justice Anthony Kennedy's preposterous opinion last week in Roper v. Simmons (March 1, 2005) holding unconstitutional the death penalty for loathsome murders perpetrated by juveniles younger than 18. Transforming the Supreme Court from airbrush artistry to principled reasoning in constitutional interpretation -- from the rule of whim to the rule of law -- will require appointments like Robert Bork and Justices Antonin Scalia and Clarence Thomas. Pastel versions will accomplish little or nothing.

You are of course referring to Mrs. ACLU. She believes the age of consent should be 8 or 9, which puts her in the morally depraved class.

He has been nominating judges.

HOWEVER FOLKS, MOST of the nominiees are coming form the CAREER GOVERNMENT WORKERS of the DOJ!

The USSC judges are usually picked from other judicial levels. I would just RELISH the idea of a non-judicial nomination to the USSC. Heck, I would welcome a Judge Bork re-nomination in order to right a wrong.

Justices O'Connor and Ginsburg are both elderly and have had cancer. Neither of them will, I think, even seek to survive on the bench to the end of President Bush's current term. So, adding Rehnquist means that Bush will appoint at least three Justices, and possibly one or two more. (Other than Thomas and Scalia, this Court is very old.)

If Bush does a good job in choosing his appointees, and Frist can get his butt in gear in the Senate Rules department, the possibility of another decision like Roper v. Simmons should be laid to rest during the lives of the Bush appointees to the Court.
