ANCHORAGE - A couple filed a lawsuit Friday against the Anchorage School District, saying their 6-year-old son was sexually assaulted by a classmate after the boys were left unattended in a school bathroom.
The lawsuit seeks damages and changes to district policies regarding how students and staff are trained to handle sexual assaults and how students are monitored.
The lawsuit doesn't name the family or the child's school, to protect confidentiality, said attorney Dennis Maloney, who is representing the plaintiffs.
The district has 40 days to respond to the lawsuit.
"I will not dispute the fact the incident occurred," Superintendent Carol Comeau said. "A sexual assault did occur. I think the perpetrator has some serious problems that need to be treated and dealt with. That is a very unfortunate incident."
School officials would not say where either child is now attending school but said they are no longer classmates.
"We are not going to prosecute a 6-year-old boy," police spokesman Ron McGee said. "There is no case here, as far as we're concerned."
The lawsuit contends that on Sept. 14 during the 45 minutes that the two were alone in the bathroom, "Perpetrator No. 1 terrorized, fondled, bullied, sexually assaulted, sodomized and raped Child No. 1."
Perhaps Perpetrator No. 1 is the child of a "loving" adoptive homosexual couple. One thing for sure, Perp 1 is being molested and raped by a man.
Why not sue the Voters who elected the School Board, who hired the Teachers, who allowed the kids to go to the bathroom?
The best way to protect taxpayers from future incidents is to not allow children in the schools.
If the parents want to make some money, they should sue the creators of the little rapist. instead of raping the taxpayers.
Good God at 6 yrs old he is sodomizing children!!! that boy needs to be in a mental facility! Sounds like he is still in the school tho and will continue to abuse other children as the school protects and passes him around to other classrooms...kinda like the Catholic Churchs answer to sexual abusers.

How in the world were they alone in the school for "45" minutes?
You are the winner, I hope to God that protective services are on this case. A normal 6 year old would have no idea about that behavior, but for having it practiced on him.
You might be amazed to know how often this actually happens.

Maybe UNFORTUNATE where YOU are concerned Supeintendent but what about the child who was assaulted?
I think it is highly probable, although apart from an allegation made against someone for sexual abusing the youthful perp, there is very little they could legally do apart from offering services to the family, unless there are younger children in the home. That would be a different story.
More money to be had by suing the school, don't you know? As for educators, you cannot just go into the restroom to see what is going on these days as a parent can also include the teacher/educator in the lawsuit, saying that you molested the child. What child will stand up against their parent in court? These are very dark days in the public school system, and probably everywhere. However, it stands to reason that when you remove the structures that our institutions relied on to keep order and trust, then it's everyone against the other and the one who wins is the one able to conjure up the most sympathy from the judge and jury. Sad state of affairs.

That's a bit of a leap...for all you know this kid was abused previously and is now in the care of someone else.
My brother and his wife adopted three children that were abused, neglected and abandoned by their drug-addicted natural parents. They have had to deal with a number of lingering problems.
I think it's pretty obvious that the child in this story needs to be receiving special care, and not in a normal classroom with other kids.

Hang on my friend. It's a lawsuit contention, not a fact. The school did not see it happen.
Frankly it's hard to believe. Kid might just be a little pervert, but he's still only six. I have a suspicion the charges are exagerated. If it's substantiated, I'll stand corrected with a sick stomach.
I'm smelling more of a lawsuit right now then anything else.
Also notice that the police are not going to prosecute. Probably because they have no case.
