Judge releases DCF document in Schiavo case

A judge released the DCF document seeking intervention in the Terri Schiavo case. She's the brain-damaged woman at the center of a "right to die" battle.

The department of children and families document names Michael Schiavo as responsible for the mistreatment of his wife. The nine complaints cited are very technical. They essentially claim the abuse or neglect of Terri is in the form of the kind of medical treatment Terri is, or in some cases is not receiving.

The complaint accuses Michael Schiavo of: 1. Failure to educate using certain therapies in violation of guardianship 2. Experimental procedures performed without proper medical and legal procedures observed. 3. Lack of manipulation of the ward's (Terri’s) arms causing severe contractures

Circuit judge George Greer says he will make the document available to the public tomorrow. Greer ordered Terri Schiavo's feeding tube be removed March 18th.

To anyone who thinks money should decide this issue. Please promise to go without food and water for the whole time it takes Terri to die if the tube is removed. Please promise to send a copy of zarkman's post to all nursing homes and rehab centers in your area. Please promise to never, ever go on Social Security, Medicare or recieve any kind of taxpayer subsidized relief. Including any post disaster aid. Please promise to fight against programs such as WIC and immunization programs for the poor. Please promise you will allow someone to decide that you should die a brutal agonizing death cause gee they did a balance sheet and the numbers just ain't right.

So let me get this straight. You acknowledge you have no idea how she feels, yet you insist she would be better off dead? Strange reasoning.
If you choose to be slowly starved to death sometime in your life, then go ahead - It is your choice, but I would certainly hope that no one would use your line of reasoning to decide whether you were to live or to die.

This is the reason I didn't put myself down as an organ donor in my living will, as much as I'd like to. You can't leave any ambiguity...there are cases of organs being harvested before a person is dead. No thanks!

To all of the people oozing "compassion" (read: oozing like slime) that Terri's family may not be able to care for her, so let's just off the nuisance...your lack of real compassion is quite apparent. Your suggestion is that people are valued only by how much they contribute or by how little trouble they cause others. Michael spent all of Terri's rehabilitation money, which was amply supplied to him for her good. I say we make him give the money back, then her parents can afford to see to her care. Barring that, I have no doubt that the Schindlers care enough about their daughter to see to her needs NO MATTER WHAT. Stop the phony piety...it doesn't wash.

There has only been a week or two since the DCF got involved again. The document says they were contacted via the hotline on Feb. 18th and 21st. They filed this with Greer two days later. A week later he decided to open the file as per the media's request.

The DCF has come under fire recently (January) for dropping the ball on lots of investigations. They're trying to clean up the messes that have been made. It's all been in the news, but if you haven't been paying attention to Terri's case closely, you probably would have missed it. Most people who even read about the ongoing problems at the DCF probably didn't even realize that the DCF's sloppiness might have an impact on Terri's case. One person was demoted (can't remember the name right now), and it looks like someone else is trying to salvage their reputation. To the outsider, this may look sudden. Heck, even the media should have had a better grasp than they have, but they don't always put two and two together until it stares them straight in the face (like when DCF *suddenly* shows up at a hearing for Terri).

People want to think that Jeb is behind this, and he may be, but only to the extent that he told the people within the DCF to get their acts together or they'll be demoted, too. People sometimes begin to do their jobs properly when they've come under scrutiny.

Please get over this notion that the *do-gooders* are going to try to take away your right to sign a living will. Have at it, man! I don't care about how you die unless you HAVEN'T signed one of those things. If you didn't need to sign one to be offed, then why do we have them in the frst place? I see them as contracts. Terri's only contract is allegedly verbal. We are talking about a woman's life or death here, not a job. It's a little more permanent! No court would make you lose your job with only a verbal contract that you agreed to it. Why should our lives be any less important? If you want to make out a living will, go ahead and do it. I will NOT stand in your way!

if that relationship is needed to justify the do-gooders taking away Mrs. Schiavo's choice, then blocking the choice was unjustified in the first place

That relationship was not NEEDED to justify anything, but it only adds fuel to the fire that for years Michael has NOT been interested in trying to do ANYTHING in Terri's best interest. If he had been interested in what was best for Terri, he would have lovingly provided for the best of care, including treating UTI's when she got them, including routine dental care, and many other things. People deserve fresh air, man!

You also have a warped sense of marriage if you think that for better or worse means to deny someone treatment for UTI's, or routine dental care, or visits from siblings, or therapy when your arms and legs need it. Michael has admitted this in court depositions (the non-treatment of UTI's) back in 1993. The rest can be verified, because Terri's arms have contractures which could have been alleviated to a degree, and she had five teeth that were extracted last year due to neglect of regular dental care all these years.

Brain dead people cannot do any of the things that Terri can, like breathe on their own, regulate their heart beat on their own, open their eyes, blink, etc.

The bone scans that show injuries inconsistent to the story of Terri's collapse show that Michael may have been the one to put her in this condition to begin with. If you have followed the case, you will see that while Michael was suing for money for Terri's care and rehabilitation he took her out, dressed her up, did her hair and make up, etc. Once he got the money, he miraculously remembered that she did not want to be kept alive artificially. So, she was sent to the hospice, all physical and mental stimulation therapy was stopped, she has not been outside in years, the nurses are ordered to have limited to no conversation with her, visits are at his discretion and are kept few and far between. She is not to be given antibiotics when she gets an infection. She does not get regular dental care.

Please study the whole case before you comment. There is more to it than what one sees on the surface. There are doctors who say she can learn to swallow and eat and drink on her own. A nurse has documented Terri used to eat jello before Michael put a stop to it.

IT may be possible, that Michael was abusing her the night of her collapse and went to far. The fracture to her neck is consistent with strangling. He is afraid if she recovers she will tell what really happened to her. I know that this is an assumption, but the facts are coming together more and more. I have seen people convicted on less evidence than we have here. The Florida District Attorney needs to fully investigate this, before Michael is allowed to kill Terri. Why else would he have scheduled immediate cremation with no autopsy. Could he be afraid of what might be found.

You seem to be highly unaware that Michael refused to allow Terri to be treated for a UTI back in 1992, in the hopes that she would die, even though that was (and is) illegal. A DNR does not mean 'do not treat', but that is how Michael has consistently treated her. It sounds like you are not aware that he admitted this in a deposition in 1993. Are you suggesting that it is quite okay for Michael to go plead before a jury to get $$ to care for Terri, and then upon being awarded the $$, he refuses to have her be treated for an ordinary UTI? What kind of man are you?

Yes, Michael is one loving husband...so devoted to his wife! (barf)

I forgot to add at the end of my lengthy post to you, I am truly sorry for what you had to go through. I realize that you have gotten some nasty comments for your opinion that comes from your experience. My post was to enlighten you as to some of the facts you may not have been aware of.

When one looks at the whole story time-line, it just doesn't seem right. I just get a feeling that there is a whole lot more going on here, and allowing this man to end Terri's life is wrong. Especially now that there are reports of Michael stalking an ex-girlfriend and running her off the road. I feel that he is a ticking time bomb. And, poor Terri is going to meet the same fate as his parents.

I would chip in, too. It's not about whether Terri's life is cost-effective. It's about whether the STATE can determine who lives and who dies. And when. And why.

This case should be dropped immediately and allow Mrs. Schiavo to get some peace. Maybe Florida and the Schindlers could even get a bit civilized and allow Mrs. Schiavo to receive sufficient morphine to make the whole process less traumatic.

The Schindlers will never allow Terri's peaceful death, no matter what Terri's wishes are.

The parents stated that even if Terri had told them explicitly to remove her feeding tube, they would never respect Terri's wishes. The Schindlers said they would keep Terri hooked up with a feeding tube against her own wishes.

Furthermore, the Schindlers would not remove Terri’s feeding tube even Terri had her limbs amputated or a terribly crippling disease. The Schindlers would still not respect Terri's desire to have her tubes removed if she had gangrene and all her arms and legs were cut off.


According to the Wolfson Report, (page 16) provided to Governor Jeb Bush by Court-Appointed Guardian Jay Wolfson, the Schindlers have no desire to respect Terri’s wishes not to be kept alive in a vegetative state.

Testimony provided by members of the Schindler family included very personal statements about their desire to ensure that Theresa remain alive. Throughout the course of the litigation, deposition and trial testimony by members of the Schindler family voiced the disturbing belief that they would keep Theresa alive at any and all costs. Nearly gruesome examples were given, eliciting agreement by family members that in the event Theresa should contract diabetes and subsequent gangrene in each of her limbs, they would agree to amputate each limb, and would then, were she to be diagnosed with heart disease, perform open heart surgery.

There was additional difficult testimony that appeared to established that despite the sad and undesirable condition of Theresa, the parents still derived joy from having her alive, even if Theresa might not be at all aware of her environment given the persistent vegetative state.

Within the testimony, as part of the hypotheticals presented, Schindler family members stated that even if Theresa had told them of her intention to have artificial nutrition withdrawn, they would not do it. Throughout this painful and difficult trial, the family acknowledged that Theresa was in a diagnosed persistent vegetative state.

Since the Schindlers and some of their supporters are so irrational, arguing with them is the same as banging your head against a brickwall.

The only reason Greer would release the other info is if it would give a HEADS UP to his little pets - Michael Schiavo and his attorneys. Giving them time to publicly refute every wit of the charges. They'd be on every talk show in the country and making it look like they are the REAL VICTIMS. You just wait and see.
