U.S. Defends Sealing Charges Against Former Clinton Aide

Federal prosecutors are battling attempts to dismiss their criminal case against Hillary Rodham Clinton's former fund-raising director, claiming in a court motion that they kept the indictment of him secret for more than a year to protect the identity of a witness cooperating in a separate investigation.

The defendant, David Rosen, is charged with failing to report in-kind contributions and producing a false invoice in connection with an Aug. 12, 2000, fund-raiser for Mrs. Clinton, according to an indictment unsealed in January. He has pleaded not guilty.

The government's motion, filed in federal court in Los Angeles on Monday, was in response to papers filed in February by Mr. Rosen's lawyer arguing that the case should be dismissed because the government had no justifiable reason for sealing the indictment until January and because it had erroneously brought the charges in California rather than in Washington, where the campaign finance reports were filed with the Federal Election Commission.

The papers also said that Mr. Rosen's indictment cited a law that applies to false statements made to a government agency, and the F.E.C. is not one.

Paul Mark Sandler, Mr. Rosen's lawyer, said yesterday, "We've received the government's replies and we're reviewing them closely."

Bryan Sierra, a spokesman for the Department of Justice, would not comment on the case.

The government's motion gave little indication of the nature of the other investigation or the identity of the witness. One cause for the delay may have been efforts to reach an agreement with an organizer of the fund-raiser, Peter Paul, to be a witness in the case. Mr. Paul's role would be complicated by stock fraud charges pending against him in connection with Stan Lee Media, a failed Internet company that he co-founded.

Mr. Paul's lawyer, Thomas J. Fitton, said only that his client had been cooperating fully with the government since March 2001 but that the government had not decided whether he would be a witness in the case.

Part of this indecision may stem from tension between the United States attorney's office for the Eastern District of New York, which is pursuing a conviction against Mr. Paul, and the Washington office of the Justice Department, which is leading the case against Mr. Rosen.

"If this was being handled just by the Washington office, there would be an agreement by now," said a person involved in Mr. Paul's case who spoke on the condition of anonymity because of the sensitivity of the negotiations with the Justice Department.

Judge A. Howard Matz of Federal District Court will hear arguments to dismiss the case against Mr. Rosen on March 7. The trial is set for May 3.

Couldn't agree more...how many scandals were swirling around them during Bill's first term? 5 or so? If she thinks she can run for president and have a shot she is mistaken...all those scandals will come back to the media forefront. It disgusts me the way Bill was more interested in getting oral favors than protecting this country, and Hill is trying to fool the American public into thinking that she is a supporter of the USA. She is an outright liar and shyster. Does she honestly think that she can support different positions on the same issue at different speeches and no one will notice? I say run Hill, and roll the dice, but I wouldn't want to be under that microscope if I was you.

Do you really think the MSM will go anywhere near a microscope with regard to Madam Hillary? My fear is that she will get an easy walk - look at the Senate race in NY. And, by the way, why is the government fighting to keep raps on the Rosen situation? All very confusing to me - the Bush's keep cozying up to Billy Boy and now they are making nice-nice with Hillary.

There are outlets (Fox etc...) that will not let her off so easily. Plus the internet will force the MSM to address issues (Rather, Eason Jordan etc). There is no way she can hide.

Not up to speed on the Rosen situation...I will look into. Thanks for the heads up. If true, seems pretty weird that the feds would act in that fashion.

Yes, that's it...and now I see it did have to do with this fund-raiser and the secret witness is a witness in this case AND another unidentified case.
