A judge has set a hearing for Wednesday to determine whether to make public a court document in which the Flordia Department of Children and Families is seeking last minute intervention in the case of Terri Schiavo.
Circuit Judge George Greer set the hearing after the company that owns the Tampa Tribune sued to get access to the DCF petition.
Lawyers say that the state wants to investigate possible abuse of the brain damaged woman by her husband who is seeking to remove the feeding tube keeping her alive.
Governor Jeb Bush has said he will do anything he could legally to help save Terri Schiavo's life.
The Tribune argued that the usual privacy concerns do not apply in this case because of the extensive litigation and the worldwide media coverage of the plight of the woman's parents to keep her alive.
They also say that the taxpayers have the right to scrutinize the DCF's actions in this case. 'The extraordinary public interest in this case is highlighted by the executive branch's continuing efforts to try and interject into the controversy.'

Circuit Judge George Greer set the hearing after the company that owns the Tampa Tribune and WFLA-TV sued to get access to the DCF petition. Lawyers say the state social service agency wants to investigate possible abuse of the severely brain-damaged woman by her husband who is seeking to remove the feeding tube keeping her alive.
The Tribune and television station argued that usual privacy concerns don't apply because of the extensive litigation and media coverage of the plight of the woman's parents to keep her alive. They also say the public has a right to scrutinize the DCF's actions in the Schiavo case.
"The extraordinary public interest in this proceeding is heightened by the executive branch's continuing efforts to inject itself into this controversy," the filing said.
Gov. Jeb Bush has said he would do anything he could legally to help save Terri Schiavo's life. In 2003 he pushed a law through the Legislature authorizing him to restore her feedings six days after the court ordered them stopped. The law subsequently was ruled unconstitutional.
Greer ordered last week that the feeding tube will be removed again March 18, triggering another flurry of legal filings by attorneys for her parents who are trying to block it.
Terri Schiavo's husband, Michael, contends she would not want to be kept alive artificially and won court permission to remove her feeding tube. Her parents, Bob and Mary Schindler, doubt she had any such wishes and say she could improve with therapy.
The Schindlers also dispute their daughter is in a persistent vegetative state as court-appointed doctors have determined.

BARTOW -- The author of Oregon's physician-assisted dying law drew applause at a Monday forum when she said she shudders at politicians "getting involved in the most intimate, private end-of-life decisions."
The former state legislator who shepherded "Terri's Law," which temporarily let Gov. Jeb Bush do just that in the legal tangle surrounding Terri Schiavo's feeding tube, drew rebukes when he defended the law.
The opposing views of Barbara Coombs Lee, president of Compassion in Dying, and Johnnie Byrd, who was speaker of the Florida House, set the tone Monday night for the Tiger Bay Club of Polk County's program on end of life. ...
Lee considers the law, which the Florida Supreme Court declared unconstitutional last year, an intrusion.
Byrd said legislators were clarifying their position on existing state laws and questioning the motive of Schiavo's husband in removing her feeding tube.

Every time I read something like this my adrenalin shoots up another notch or two..by the time this is over I may permanently act like I'm always drinking large quantities of very strong coffee!
This just means he set the hearing. It doesn't mean the document will be made public. And it should not because it sets a precedent down the road for families who are accused of abuse. The evil judge greer is the one who stayed the feeding tube; he was not FORCED to do anything.

Sometimes I think I'm in the Twilight Zone. This just couldn't be happening in America. :(
Not so fast .. The Tribune is chasing a story that the DCF investigation is a waste of the taxpayer's money. This is NOT a good thing IMHO.
