Go to pages 21-25 of the Opinion (can't post the text here) and read Justice Kennedy's opinion on how we need to take into account world opinion and how the Court should look to "the leading members of the European Community" in deciding on some cases. If you never thought Judges were important, you should now. (This doesn't apply to most Freepers.

The external pressure of this court's decision on Bush v. Gore is now fully exposed.
There is no way Kennedy would sign onto that decision today, he'd find a Norweigian decision to help his sway his view.

The offended states that have the death penalty for 18 or under should ignore the Court. It is time. They have to have the gonads to tell the Court that they have just violated the Constitutional right of States rights. This is serious. The Court is out of control. If need be, the Senate must get involved and they have the power to reverse the Court by a simple majority by passing a bill.

The Constitution was written because the Founding Fathers found that the existing laws of the Europeans were not tho their liking. Now we're supposed to turn the them to interpret it?

The majority opinion is sickening. If there's one "litmus test" Bush should apply in nominating justices, its that they do not believe that foreign jurisprudence has any proper role in the interpretation of our Constitution.

A few conservatives tried to do this with a law to protect marriage from the likes of Kennedy and his Sodomite pals. Our fearless Republican senators, under the courageous leadership of Bill Frist, let it die. Thus the Gramscian Republicans continue the long march to the left.

Frist's choice for the Senate Judiciary, Arlen Specter, along with his Marxist legal staff, will be the gatekeepers for all nominees to the Supreme Court - assuring that only those judges who share the views of Souter, O'Connor, Ginsburg, Stevens, Bryer, and Kennedys will be approved. Next time they're campaigning, Frist and the gang will talk up the need to re-elect them so they can "fix" the Supreme Court. Nice scam.

I blame the Congress which, under the Constitution, has the power to limit the jurisdiction of the Federal courts. They've simply abdicated that power, and now five unelected lawyers can impose their whims on the rest of us.

The most inexcusable, disgusting, inexplicable failure of any political party in American History has been the Republican Party’s failure to appoint Conservative Supreme Court justices when it had the chance too.
Without a fight they ceded control of this country to the left. The left has been able to rule this country from the bench for the last twenty years because of this travesty.
The only way the citizens have to address the abuses of the court is to elect Presidents who will appoint honest judges. Bush one, Ford and even Reagan betrayed the voters of this country.
I can never have an ounce of respect for Bush the elder. The damage he did by carelessly nominating Souter is incalculable. In many ways Clinton did less damage to this country in 8 years than Bush did with this criminally stupid nomination. (It is immaterial if he was 'mislead' it is his job not to be mislead.)
If the President or the Republican party surrender to the Democrats and nominate a "moderate" to the Supreme Court. They will never get my vote again. I have made it clear to my Republican Senator this fact also.
