CNN: US SUPREME COURT: ALL DEATH PENALTY CASES WITH JUVENILE KILLERS THROWN OUT!

The Supreme Court ruled Tuesday that the Constitution forbids the execution of killers who were under 18 when they committed their crimes, ending a practice used in 19 states.

The 5-4 decision throws out the death sentences of about 70 juvenile murderers and bars states from seeking to execute minors for future crimes.

The executions, the court said, were unconstitutionally cruel.

When your neighbor's dog craps on your lawn, get your twelve year old son to use "daddy's shotgun" to off them both.

Or for less than that. How about having the kid take care of it if someone shoots the finger at you. Or, if they cut you off in traffic. Heck, I can think of hundreds of insignificant events for which someone could be murdered by a kid. How about if they're asked, "What are you going to do, shoot us?" BTW, the kid who did that one won't be executed now either, it seems.

You just watch, now that the court has said its cruel and unusual punishment to execute a juvenile, state courts will say the same must apply to adults. They pretty much banned the death penalty period, its just a matter of time now.

I support the death penalty because I think it is the only punishment that fits the crime, not because I think it is a deterrent, because I don't beleive it is. The SC ruling is nonsensical.

Better yet...all teachers are now subject to being "offed" by students who hate them for whatever reason. At least they know they'll not be executed and will probably be eligible for parole in time to party down hard in their mid-twenties. What a glorious time to be a teenager. :-)

Oh, and principals too. School board members, superintendents and hey, even policemen who interrupt drag races on city streets. Time to let the adults know who is in charge.

How about we forcibly emancipate them first.

If we want to execute them, classify them as adults first through a competency hearing, and then get on with it.


This is along the lines what I was thinking. I think the competency hearing would work. But I think the burden should be on the defense to prove that they did not know right from wrong. I don't think the Supreme Court addressed this did they? I know that you can be emancipated from your parents at 16. What happens if one of these emancipated 16 year olds commits murder. In that case, I say they are adults. Part of my hangup to be honest was the whole alcohol thing. I was in the Army, 18 years old, with an infantry batt. and I couldn't get a beer,

I was Navy in 84-89, we could drink in the base club, but obviously not in town. Has this since changed? because I wasn't "mature enough" to do it. If we want to make the age 16, let's just do it. My big objection would be overcome if we did it for jury duty. If 16 year olds could serve jury duty, I think I would be cool with capital cases being brought against 16 year olds. My guess actually is that 16 year olds would be more inclined to fry em.

If you can't be trusted to vote, buy butts or carry a firearm by the state when under 18, you shouldn't be held to the same standard as an adult by the state when it comes to execution, IMHO

It's not the place of men to kill other men, or children, even if those people have killed. God is the one who gives justice and vengence. I don't worry about not killing murderers, because I know that those people will get their justice in Hell.

The partial birth abortion ban could be the one, when it comes up for Supreme Court review, because there's an issue on which 75% of the public is in agreement that there should be limits.

The Supreme Court will strike down the partial birth abortion ban because it makes no exception for the health of the mother. Of course, in reality, that exception is what allows abortion on demand right up to labor, because "health" in an undefined, subjective term for "medical professionals" to decide.
Abortion doctors are medical professionals.
Connect the dots.

But to really be able to apply a defiance strategy, the groundwork has to be prepared. 23 states have ballot initiative processes. One can study the time it takes for cases to ripen and estimate when the partial birth abortion ban will hit the Supreme Court.
And before that a truly national effort is needed to get a ballot initiative parroting the federal statute before the voters in all 23 of those states.

It is important that the issue really be played emotionally, with the heart-rending photographs and ultrasounds that show the full, graphic horror of partial birth abortion.
Inflame the mob and get an avalanche of votes that pass bans on partial birth abortion, without the "health" exception.

Then wait patiently for the Supreme Court to overturn the Federal law, and by extension all of these popular referenda, within a few months.
Then spring the trap.
The President steps forward and orders the Justice Department to not apply this case because it is a clear example of judicial overreach and abuse of authority.
Simultaneously, have Congress pass a resolution supporting the President's position.
The precedent will be established.
Then use it.

Of course, like the "nuclear option" on filibusters, paring back an established power of government is a two-edged sword.

The Republicans will not be in power forever, after all...

Each state should take the little sobs to the steps of the supreme court [lower case on purpose]and release them. Along with the terorists the federal judges want to set free.

Let them have to live with the murdering bastards.

The States could, of course, just simply refuse to obey the decision and proceed with executions anyway.

It would then really be up to the President to decide whether or not the Executive Branch, meaning the Federal Marshalls, FBI, and the like, would enforce the rulings on the States or allow the State override of the decision to stand.

I'm afraid that WE will reap what they sow.

I do have a question as to just why this isn't a state's right issue. Many states have different laws regarding the death penalty and I don't see how the U.S. Supreme Court is absorbing the duties of the states Supreme Court.

The Supreme Court has just said that a victim's life is worth less than their killer's life. Disgraceful. This is why we need more Senators so we can impeach and remove these fools.

Have you looked at fifteen year olds lately? They aren't exactly children. But I'm sure you'll feel better when a fifteen year old kills one of your loved ones knowing that they can't be executed. And it won't stop there -- these Eurojustices will keep on going until all under 18 killers are released at 18 since they're just "children".

This ruling is a disgrace. Frist better move on the judges now.
