Terri Schiavo's parents ask judge to let her divorce husband

Associated Press

TAMPA, Fla. - Terri Schiavo's parents asked a Pinellas court judge Monday to allow her to divorce her husband - in either life or death - in a court filing accusing Michael Schiavo of adultery and not acting in his wife's best interests.

The filing was one of a flurry of 15 motions filed by Bob and Mary Schindler as they now have less than three weeks to find a legal way to keep their severely brain-damaged daughter alive.

Terri Schiavo is scheduled to have the feeding tube that has kept her alive for 15 years removed March 18 unless her parents can convince an appeals court to block Michael Schiavo again. Michael Schiavo says he will have the tube pulled because his wife once told him she would never want to be kept alive artificially.

David Gibbs, the Schindler's attorney, said Pinellas Circuit Court Judge George Greer has indicated he will not hear the divorce request and five other motions filed Monday - but that only means that the matters are now on their way to being appealed to the 2nd District Court of Appeal in Lakeland........

Many of these pro Terri death posters think that their desire for independence, autonomy, control etc will override their survival extinct if they ever become disabled and have to live in a less than optimal state(by their current thinking). I have news for them, while many become depressed, even most of those will become quite adapted to their state. While many will ask for someone to kill them, they will also scream if one of the staff is too rough, complain if they are hungry, or their needs are not met on time. People tend to adapt and achieve a certain comfort level in whatever current physical state they find themselves in. And most of the skilled nursing patients I have taken care of did not want to die, especially by starvation or dehydration.

I believe Terri has told us she wants to live in the only way she has been allowed, by surviving all the abuse and neglect that has been heaped on her.

However, even if there were grounds, show me a state that ever allowed divorce by proxy.

Name me a state that starves people to death on hearsay evidence.

I'll wait while you go look that up...

Oh, didn't find any? seems we're in new legal teritory here, eh?

Hey Mom....if you ever keep me alive like this...I'll get even with you in heaven.

Fair enough, but don't blame her when she starves you to death.

Yes, and in 2003 when they tried to kill her, the concubines mother stood guard. Can you imagine something so disgusting.

Well, the concubines mother died recently. The same one
who sat in the same room with Terri while they were trying to starve her.

There are various laws having to do with Protective custody, prevention of abuse of the disabled, felony neglect, attempted murder, etc. many statutes. I need more specificity.

Playing the Nazi card, are we? That pretty much says all that needs to be said.

[Sound of Silverback clearing throat]

From the United States Holocaust Memorial Museum online exhibit "The Doctors' Trial":

On December 9, 1946, an American military tribunal opened criminal proceedings against 23 leading German physicians and administrators for their willing participation in war crimes and crimes against humanity. In Nazi Germany, German physicians planned and enacted the "Euthanasia" Program, the systematic killing of those they deemed "unworthy of life." The victims included the mentally retarded, the institutionalized mentally ill, and the physically impaired.

Now, was she out of line to imply any connection between you and the Nazis?

Yep, absolutely.

But are Felos, Greer and (to some extent) Michael Schiavo pulling the old goose-step on Mike's better half?

You better believe it. This is far less about Terri than it is about Singerian/Mengelerific medical "ethics.

Oh, and could we remember here that she will be killed through dehydration? Somehow, I think that makes it cruel to remove the feeding tube no matter what condition she's in or what evidence her husband offers.

Especially since the concubine would lose the house she is in since Terri's money provided it.

Everything the concubine has, 1/2 of it belongs to Terri. Even more if it is proven that HINO abandon her and tried to kill her (he is trying to kill her).

So, people should look at the basic facts. Look what HINO and the concubine have to lose or gain by Terri living or dying.

The tramp had no business having those kids. She deserves everything she gets. God forbid something happens to one of those poor kids and HINO decides their fate.

I'm curious, but do the children of this union figure into this at all, or are they dismissible because you don't like the parents?

Um, Melas...grip, please?

First, it's not as if she wrote a book about ths case and never mentioned the kids, she wrote a tiny little paragraph.

Second, where's your evidence to conclude anyone on this forum finds these children "dismissible?"

Third, I don't see how Terri Schiavo starving to death helps those kids. If it's so important that he be married to their mother, then he should divorce Terri and marry his girlfriend.

"Greer wrote in the 3 page decision that he was no longer comfortable granting stays"

Well now there's a competent judge if I ever saw one. Making decisions on life and death matters based on how comfortable HE is.

Hey Greer,
How "comfortable" do you think Terri will be while she is enduring being starved and dehydrated TO DEATH?! How "comfortable" do you think Terri's mom and dad and siblings will be watching their daughter/sister suffer, while she is starved and dehydrated TO DEATH ?!

If you're "uncomfortable" then recuse yourself from this case, you lazy, cold hearted, miserable excuse for a human being. Terri has not had a fair trial ever, not once. She has had to suffer years of abuse and neglect at the hands of her adulterous husband, who is UNFIT to be her guardian, because of you.

He was abusing her before her "collapse". Terri was considering divorce. But you refuse to listen to her family, her mom, her dad. You deny, deny, deny and take the word of her adulterous husband, who was abusing her before she collapsed. You continue to allow him to be her guardian.

Here's a suggestion "judge".. next time you go to the restroom.. take your Law degree, and whatever says you are a "judge" and wipe your a$$ with it. You are no upholder of law, no defender of the helpless, or protector of people's rights.

You couldn't even research this case if you wanted too, because you are legally blind ,and maybe that's your excuse, but, when an innocent woman's life is on the line, and you plan on subjecting her to a death that is so cruel, it can't be used on death row inmates, there is no excuse.

You should have recused yourself a long time ago. You have sentenced an innocent, helpless woman in a wheel chair, to a tortuous ,cruel death. Are you proud of yourself? How many more innocent disabled people will be brutally starved and dehydrated based only on flimsy hearsay evidence from their "guardians" who may or may not gain financially from having their wards killed. How many people's blood do you want on your hands judge?

I pray for your immortal soul that the veil of deceit will be removed from your eyes, that you will see who it is you have been serving, and that you will turn from this path.

In the name of GOD,
and for the sake of your own soul-
LET TERRI LIVE,
RETURN HER TO HER PARENTS.

I suspect that most of you "veterans" wouldn't accept Michael's approach even if Terri had said exactly what he claims.

The problem with your statement is that even if true (and it is in my case, you'll see why in a second) it's worthless. You see, even if she said "I wouldn't want to live life on a machine" or even I wouldn't want to live life as a vegetable," there is now way she said or meant "Please, starve me to death if I'm ever brain-damaged." that's what he wants to do--make her die of thirst and hunger. Sorry, I'm not buying that this is her wish, nor should any reasonable person. For that matter, neither should Michael Schiavo.

And BTW, you're trying to have it both ways: You claim that we are ignoring reality, but when we demand evidence that Michael Schiavo is following his wife's wishes, you hand us hearsay and want to give him the benefit of the doubt. Well, if you want to believe that hearsay evidence is enough to kill somebody, bully for you, but don't blame us for not buying this crap.

I wouldn't accept Michael's approach because Terri isn't PVS according the definition given in the Florida statutes, something Greer likes to conveniently overlook.

If there is a lot of money to be gained here, I'm willing to look at evidence.

You do well to follow the money. According to Felos at the beginning of Feb. there was about $60,000 left in the trust fund for Terri. That's not nothing, at least where I come from. It might be to someone who lives in a $400,000 home, but to me it's plenty.

Next, I think it is extremely likely that there is a life insurance policy on Terri from at least the days when she worked for Prudential, before her collapse. Big companies like that often have perks for even the rank and file employees, and I'm sure life insurance, perhaps even at reduced rates, would be one of them.

I also suggest you consider that since Michael's girlfriend is in the insurance business, it's not too far out of reach to think that he could have gotten a policy out on Terri through Jodi.

On top of that, I'm guessing that there's a good bit of money to be made off of book and movie deals, knowing the way Hollyweird is.

Michael has plenty to gain financially even if there were absolutely nothing left to inherit from trust funds, but I'm pretty sure there's enough in those to give Michael motive.

The one I'm thinking of specifically prohibited removing basic supports like feeding tubes from a individual.

Yet more hearsay that Greer ignored. Fact is, he shouldn't have allowed any self-serving hearsay to be admitted at all.

Let me reiterate Spotted' challenge...

If Michael gets to pull Terri's feeding tube, do me a favor and forgo food and water until she finally dies.

The lst time they got the tube pulled, she lived for six days without it. C'mon, you can go without water for six days, right? Just to see what it feels like.

Greer has orchestrated the death of another woman already. I have unfortunately, forgotten her name at this hour. I'm sure she isn't the only one out there, either.

FV, the one who was seeking a restraining order against her husband, do you remember her name? Greer denied her request, and then she was found two weeks later, murdered by her husband. Greer didn't think he had enough evidence that he wanted to kill her, even though he tried to burn down her house. Greer often reminds me of that judge in Bradenton that let Carlie Bruscia's murderer out. Bill O'Reilly did one good thing by helping get that judge's ouster.

Michael's attorney put out that Terri would have a lifespan of 51 years. The jury awarded enough for 17 years. It's in the court documents.
