TAMPA, Fla. - Terri Schiavo's parents asked a Pinellas court judge Monday to allow her to divorce her husband - in either life or death - in a court filing accusing Michael Schiavo of adultery and not acting in his wife's best interests.
The filing was one of a flurry of 15 motions filed by Bob and Mary Schindler as they now have less than three weeks to find a legal way to keep their severely brain-damaged daughter alive.
Terri Schiavo is scheduled to have the feeding tube that has kept her alive for 15 years removed March 18 unless her parents can convince an appeals court to block Michael Schiavo again. Michael Schiavo says he will have the tube pulled because his wife once told him she would never want to be kept alive artificially.
David Gibbs, the Schindler's attorney, said Pinellas Circuit Court Judge George Greer has indicated he will not hear the divorce request and five other motions filed Monday - but that only means that the matters are now on their way to being appealed to the 2nd District Court of Appeal in Lakeland........

I don't need to know. I'm just glad that they are objecting to Terri's summary execution by J. Greer in addition to investigating "secret" persons of interest. (the broken wheelchair is a condemnation of the judge, the hospice, and the husband in name only. That's just the tip of the iceberg.)
That I wouldn't know, but they are in there with them almost every day.

But didn't remember it until 7 years after her collapse. Faulty memory?
I was just wondering...if all is lost and the tube is removed from Terri, would the family be barred from attempting to feed her by hand? I haven't heard anything about this and was just curious.

I think Terri has a chance this time. I refuse to give up hope that she will be rescued from this nightmare. Considering how much money she was awarded for her care, the broken wheelchair is a slap in the face.

Hey, if Mr. "She told me she wouldn't want to live like this, no really she did" were to get put in his place by this mauever, I would love, love, love it. After all, her parents saying "She would divorce him" is at least a s credible as anything he's claimed.
The estranged husband has thought of that, and barred her family from being with her the last time the court allowed him to starve her to death.
There were police posted outside her door, and his girlfriend's mother sat in the room with Terri while she was going through that.
It sounds like something Hitler would have dreamed up.
Judge Greer said in his courtromm (I beleive it was when the feeding tube was last pulled) that he didn't want anyone feeding THAT girl.
That's correct TAdams....he didn't even use Terri's name...just said "I dont want anyone trying to feed that girl"
He has effectively divorced his wife and taken another family. For him to remain married to both is bigamy. While you say he is not married to the latter, clearly it's a common law marriage. Clearly, it's an act of adultery, in any case, which by even older and valid Church standards was a legitimate reason for nullification, and has generally been considered an automatic and unquestioned grounds for divorce in government courts.
Yeah, and didn't the girlfriends mother die recently at home?
It's perfectly plausible to envision Terri watching a movie, or TV show and uttering, "If you ever do anything like that to me, I'll divorce you!" or "If my husband ever does anything like that to me, I want a divorce."
In fact, let me document it right now, "if a husband of mine ever treats the way Michael Schiavo has treated Terri, I WANT A DIVORCE and AN ANULLMENT!

Later, the Schindlers said they began to believe that maybe Michael Schiavo had "done something" to Terri, causing her to stop breathing, which is what appeared to have caused oxygen deprivation leading to severe brain damage. Medical reports, a bone scan and a police report eventually caused them to become suspiciousas did Michaels unwavering watchfulness from the beginning.
When the Schindlers said they finally got access to Terris medical records, they discovered she had a neck injury consistent with strangulation, they said a doctor told them. Mary admitted she remembered having seen an unusual number of bruises on her daughters arms and thighsand wondered about them.
They also knew Terri may have wanted a divorceand mentioned that to her brother, her friends, and her mother about a month before her collapse. Glancing at Bob, Mary said Terri would never have told her father.
"She just said, Michael and I are really having some problems and Im really not happy," recalled Mary, who admitted: "Dummy me, with my Catholic upbringing and all, I said, honey, maybe just try to work things out."
Mary said she remembered thinking right after Terris collapse that Michael was extraordinarily attentive for having been thrust into such a situation. She recalled five other young women in Terris condition at a nursing home in Sable Pondsand said their mothers told her that each of their husbands "flew" after they realized their wives would likely never be the same.
"I thought, look at this loving man thats here every day. He watched her like a hawk. Naturally, now I know he was afraid. He must have been thinking, what if they teach her to talk?" Mary speculated. "I think he was afraid she would say, what are you doing here? You did this to me! I think thats what happened."
Bob said he remembered thinking right before the malpractice trial, which began in 1992, that something was wrong, but he couldnt put his finger on it.
"I didnt lay up at night and think, why is he doing this, but when we finally got access to her medical records, I wondered," Bob said. "Something just didnt seem right with this guy."

My thinking as well, except, perhaps the court would appoint a SPECIAL Guardian for Terri for the divorce case...that would then provide her some additional protection since this guardian could speak for her life as well?
