TAMPA, Fla. - Terri Schiavo's parents asked a Pinellas court judge Monday to allow her to divorce her husband - in either life or death - in a court filing accusing Michael Schiavo of adultery and not acting in his wife's best interests.

The filing was one of a flurry of 15 motions filed by Bob and Mary Schindler as they now have less than three weeks to find a legal way to keep their severely brain-damaged daughter alive.

Terri Schiavo is scheduled to have the feeding tube that has kept her alive for 15 years removed March 18 unless her parents can convince an appeals court to block Michael Schiavo again. Michael Schiavo says he will have the tube pulled because his wife once told him she would never want to be kept alive artificially.

David Gibbs, the Schindler's attorney, said Pinellas Circuit Court Judge George Greer has indicated he will not hear the divorce request and five other motions filed Monday - but that only means that the matters are now on their way to being appealed to the 2nd District Court of Appeal in Lakeland........

Michael presented evidence. It may have been fabricated, but no one has contradicted it.

Wrong. Terri's friends prepared affidavits contradicting what Michael claims Terri said. Also, Cindy Shook, one of Michael's girlfriends, while Terri's been in the hospital, also prepared an affidavit contradciting what Michael claims Terri said. Concerning Cindy and Michael's relationship, she said:

Schiavo was abusive in their relationship and nearly ran her off the road when she tried to break up with him.

Regarding what Terri would have wanted she claims Michael Schaivo said:

"How the h*** should I know we never spoke about this, my God I was only 25 years old. How the h*** should I know? We were young. We never spoke of this."

This whole thread is about divorce by proxy. Terri is unable to file for divorce on her own behalf.

A quote form the story above. Just ANOTHER OUTRAGE in a case full of them. Michael keeps her ISOLATED and once would NOT allow her family to see her for 55 days.

What woman would want to remain married to such a man?

You don't know anything about me, so keep your judgment to yourself.

I can't say what Terri would want in this situation. And neither can you. What I do know is that you have demonstrated your willingness to cast honesty aside on this issue, so nothing else you have to say on the topic should be credited in any way except as a statement coming from one who wants a chosen outcome and will say anything to obtain it.

She did say it. She told her friend. When I posted to you, I hadn't read what another person subsequently posted regarding that information.

The only complicated thing for me is why YOU don't get it. All of us here have been thinking very hard on ways to help Terri out of this nightmare. The judical system in this case has been compromised by a conflict of interest, therefore let us turn the tables and play by their rules.

Now do you get it?

"NO MATTER. A GENERAL MASTER IN PINELLAS COUNTY CAN HEAR PETITIONS FOR DISSOLUTIONS OF MARRIAGE. The more Greer says "no", the more he looks like a cereal killer.

Not with out being assigned by the judge and moreover, not without the consent of all parties to the action.

It's my understanding that said money for therapy is long gone. Do you have a source with a different accounting? If there is a lot of money to be gained here, I'm willing to look at evidence.

Brilliant!

What Terri needs is for one of her friends or family to state that Terri saw a movie or news about a guy that is married yet living with another woman and having kids with the other woman and Terri stated, at the time, that she would divorce Michael if he did the same thing to her!

Should be given the same weight as other declarations of Terri that never made it into writing.

Her legal guardian testified to it under oath.

And two others collaborated his testimony. Is it suspect and perhaps even a lie? Perhaps, but the wild speculation and innuendos spouted on FR are far more over the top.

You've seen Judge Greer's work I gather from your words. He's MANGLED THE ENTIRE GUARDIANSHIP-PROBATE DEPT. OF THE SIXTH CIRCUIT COURT, PINELLAS COUNTY.

How can we expect the people to understand the judicial system when the JUDGES KNOW EVEN LESS THAN THE PEOPLE?

People do however, understand the concept of judicial tyranny.

Give me a break Melas, the kids are as much victims in all of this as they have terrible parents. But this case isn't about those kids as they will live, it is about Terri!

It just struck me as...well, out of politeness I won't name it, but it struck me when I read that someone wanted to keep the parents of two children apart. No matter how anyone feels about Terri, I found that troublesome.

I see. I got caught up talking about divorces in general and what Terri would or would not want.

I don't know of any states that have divorces by proxy.

I know that most states have statutes that allow divorces for incapacity/mental reasons, and if filed by the person seeking a divorce, they would have to appoint an attorney for the incapacitated party.

Her parents can't sue and the petition would most likely be thrown out. Its a good move, but I am afraid this would be valuable time spent lost on a particular.
