Terri's Freepers,

Judge George Greer denied Terri's parents' Motion for a Stay to protect their daughter's life while there are still pending issues in this LIFE AND DEATH MATTER. In addition the Department of Children and Family Services made a surprise visit to the court hearing the other day and asked Judge Greer if they could approach the bench. Judge Greer denied DCF the opportunity to speak. DCF asked for 60 days to conduct a complete investigation of allegations that have surfaced in the form of a Complaint to their agency.

What was set in motion instead? On Friday, February 25th, Judge Greer REFUSED TO issue another Stay because he was "not comfortable" issuing a say to protect a Ward of the State but instead "set a date certain" (on his calendar at least, not on mine) to BEGIN THE BARBARIC, ANTI-AMERICAN, STARVATION-DEHYDRATION SLOW MURDER OF TERRI.

Attorney Gibbs for Terri's parents held a press conference after J. Greer's order that was so tastefully written to indicate that "he was giving the Schindlers until March 18th so they could "prepare for Last Rites." Attorneys Gibbs called this ruling and prior rulings "Hitler-resque". Indeed.

If Judge Greer wasn't LEGALIZING EUTHANASIA in his courtroom, why any need for Last Rites? Greer's urgency to fulfill this killing places urgency on every one of us to lobby Governor Bush, Florida's House and Florida's Senate.

A Judge in America is ordering the manner of someone's death, a disabled woman who is healthy but needs rehabilitation.

Time is short so we don't really have time to get into Greer's mind to see why he is Florida's Til of the Hun.

I have not been in FL since 1989 and never intend to go back. I had to travel in the summer, and FL is not a pleasant place in the summer either. But I probably would have not returned there even had the Schiavo case never happened.

In Terri's case, under Florida statutes, witholding water (and food)
from a conscious, non-vegetative disabled person is a FELONY.
Here are the words of Governor Jeb Bush from his amicus brief on
behalf of Terri in October, 2003:

"The Governor submits this memorandum to ensure that the Court
consider the critical distinction between removing artificial life support
and the deliberate killing of a human being by starvation and dehydration.

"These are two different actions. The first is performed according to
state law and is allowed under Florida's constitutional right to privacy.

"The second is prohibited by the right to life enshrined in the Florida
and federal Constitutions. . ."

"As Terri's death may be proximately caused not by the removal of life-
prolonging procedures, but the denial of oral sustenance, forbidding the
provision of oral sustenance would create an unnecessary conflict with
Florida statutory law..."

". . . natural oral feeding is not a life-prolonging procedure under
Florida law.

"An incapacitated person retains certain enumerated rights under Section
744.3215, Florida Statutes (2003).

"That section clearly and separately delineates which rights are retained
by the ward [Terri] (Section 744.3215(1));

"which rights may be removed by the court (Section 744.3215(4));

"which rights may be delegated to the guardian (Section 744.3215(3)); and

"which rights the guardian may not exercise without first obtaining

Since Terri is NOT in a "permanent vegetative state", CLEARLY the law is
about to be broken regardless of what a judge or appeals board says.
They cannot nullify the law. And just as in the military, police officers
must NOT carry out an illegal order.

Florida police officers, THE WHOLE WORLD is watching, and the whole
world has seen the video clips of a very responsive Terri Schiavo. If
Judge Greer's court order makes it impossible for you to view those clips

It is obvious that you and the Florida Department of Children and Families
have more than enough justification to act to put Terri under their
custody while the many allegations of wrongdoing by Terri's husband
Michael Schiavo are investigated. DCF has asked for a very reasonable

down.

YOU **CAN** INTERVENE, and in fact, police officers are
REQUIRED to intervene.

Please - don't allow Florida to be known best for torturing the disabled
to death. Think about how this will play out in your consciences for the
rest of your life. You are in the unique position of persuading your

Personally, I like Florida. Spent some of my childhood there, but I've set it off limits. Not giving them my dollars if I can help it. I even hated paying for the hotel when I was there for the rally, but that was for a good cause.

Accuracy, teaching should enlighten Schiavo case

My first comment on the Terri Schiavo case is that publications or commentaries should be based on factual accuracy — particularly accuracy that would stand up in a court, which is where this case has been decided and where it will eventually be determined. The second point is on the church's teaching on this subject. On this subject, of course, I am a lawyer and not a theologian.

However, I did come to Tallahassee in 1969 to represent the Florida bishops, the same year the first Death With Dignity bill was filed in the Florida Legislature; it was also the first in the United States and, in fact, in the entire civilized world. There was nothing directly on this subject at that time, but a lot of statements on euthanasia, and on the ethics of withdrawing extraordinary means from patients. Having become embroiled immediately in the subject and involved in the statewide and national debate, and in innumerable conferences with the bishops and theologians in Florida, I would like to offer some thoughts.

I. Factual accuracy

The basic facts in the Schiavo case were litigated for years in the circuit court in Pinellas County.
Both sides were ably represented by counsel, extensive testimony and records were introduced on the very matters now found in e-mails and blogs, and the court considered these in repeated trials and hearings. That court's decisions were appealed any number of times by the parents, and were upheld.

Anyone is entitled to disagree with a court ruling, but repeating facts that have been repeatedly rejected by courts without acknowledging the court's findings is misleading, to say the least. The recent statements of the Catholic bishops of Florida are good examples of accuracy and of what I am advocating here.

In the third appeal, in 2001, the District Court of Appeals for the 2nd District upheld the lower court's finding, by clear and convincing evidence, that Terri Schiavo was in a persistent vegetative state and that she wanted the feeding tube withdrawn. This was based on the extensive record, briefs and oral argument of counsel for both parties. However, because an affidavit of a doctor, board certified in neurology, had been filed by the parents stating that, in his opinion, Mrs. Schiavo was not in a persistent vegetative state, the court, since a matter of life and death was involved, remanded the case to the trial court to review this sole issue once again.

That decision was then appealed to the Florida Supreme Court, which turned it down, leaving the district court's ruling intact. On remand in the circuit court, the guardian named two doctors to testify, the parents named two other doctors (but not the one who had filed the sworn statement that Terri Schiavo was not in a persistent vegetative state). The court then appointed a doctor who was the head of neurology at the Cleveland Clinic, a very noted medical clinic in this country, who was also a professor of neurology at Case Western Medical School.
The guardian's experts and the court expert all testified that Terri's cerebral cavity was filled with spinal fluid and there was no brain matter there. The parents' two experts, taking a different tack than had been taken in the appellate court, testified that there were isolated brain cells in the spinal fluid, and that they would like to try to rejuvenate them.

They admitted that it had never been done before, but were willing to try to rejuvenate them. After hearing the evidence, the court rejected the parents' claims and reaffirmed its previous order, which was again appealed to the district court.

The District Court of Appeals subsequently entered its final ruling, which to my mind was a very pro-life ruling, reaffirming that this was in fact Terri Schiavo's decision, not her husband's nor anyone else's; secondly, as to her condition, it affirmed the decision of the trial court that she was in a persistent vegetative state. The ruling, which eloquently reflects its care, diligence and deep personal interest in this case, can be found on the Internet at www.2DCA.org. The reason I point this out is because all of the e-mails and blogs omit these facts as if they don't exist.
This was litigated vehemently by both sides. The only ones who have heard both sides of this case are the courts and they have rejected the claims now being so widely circulated. I think that when statements are made this has to be taken into consideration. Otherwise those making the statements, regardless of who they are, diminish their standing, before the legal profession and the courts, and probably history itself.

II. Church teaching

Over the years, in fact as long as I was with the conference, the subject of euthanasia, of withdrawal of extraordinary treatment or undue burdens, continued to be a problem and one that demanded careful study. One of the early lessons I learned, which was followed through on, was spelled out in an allocution by Pope Pius XII to anesthesiologists and others to the effect that the decision of what is ordinary or extraordinary does not belong to the medical profession or to the church, but can only be decided by the patient or, if he is incapable, his family.
I have repeatedly read the 2004 allocution by Pope John Paul II to the medical community that contains very strong words about the withdrawal of nourishment from someone in a persistent vegetative state. I found in the beginning of the fourth paragraph, the statement was directed specifically to the medical community, society and the church. Nowhere in the entire allocution did I find any reference to the right of patients to make such decisions and I can only assume that this was deliberately done.

The law does not necessarily agree completely with church teaching, but if Terri Schiavo is the one making this decision, and not her husband, the doctors or the church, then it seems to me that the two are not far apart. Thus I do not think that this matter is as simple as some would have it.

Citizen's Arrests have to be taken seriously by law enforcement.

They would be well to do so. Now maybe we can get some REAL attention by the MSM (not holding my breath) on the horrible facts of this case.

I called Congressman Oxley again today and his aide said that they are getting alot of calls on HR1151 and she asked me for my name and address.

I called DeWine and had trouble getting through because the phone was busy...when I did get through, the aide was extremely nice and knew what HR1151 was and they are getting lots of calls again...they took my name and address

I got Voinovich's office and got through right away and the male aide knew about HR1151 and said that they are keeping track of what contituents have to say about the bill. He said he got my name but he didn't ask me to spell it which is rare and he didn't have me repeat my addy...so I think I will have to call them back until they get it right.

New York * Agudath Israel of America has issued a public plea to the husband of Terry Schiavo, the brain-damaged Florida woman, to not remove the feeding tube keeping her alive.

Circuit Court Judge George W. Greer ruled Thursday that there was no merit to an appeal to delay permission for Michael Schiavo to allow his wife to starve to death, in opposition to the wishes of the incapacitated woman's parents. The court, following Mr. Schiavo's wishes, has ordered the feeding tube removed on Friday, which prompted Agudath Israel's plea.

A spokesman for the national Orthodox Jewish organization appealed to Mr. Schiavo to "recognize that what a court may consider legal can still constitute a grave violation of a higher law," and asked him to "please allow your wife to continue to live."

"None of us can claim to know what constitutes a meaningful existence," Rabbi Avi Shafran, the organization's director of public affairs continued, "and all of us have a responsibility to preserve even severely compromised human life."

Jews, Christians, atheists, etc. ALL KNOW THIS IS A COLD BLOODED MURDER.
