Jervis S. Finney, chief counsel to Gov. Robert L. Ehrlich Jr., has questioned members of the media - including two Sun reporters - about "MD4BUSH," an anonymous contributor to a Web site that posted adultery rumors about Mayor Martin O'Malley. Finney said he was asking the questions as part of his investigation into the activities of Joseph Steffen, an aide to the governor who was fired February 8 for his involvement in spreading the rumors about O'Malley's personal life, The (Baltimore) Sun reported. O'Malley has denied the rumors. MD4BUSH had several Web log exchanges with Steffen about the O'Malley rumors and gathered a number of Steffen's most damaging postings on the Web shortly after the story reporting Steffens' connection with the rumors broke on a media Web site. In a Feb. 16 letter to Sun reporter Michael Dresser, Finney cited a federal appeals court panel's decision this week that undercuts reporters' right to shield their sources. In a separate letter to Sun columnist Michael Olesker, Finney asked "whether you are in fact 'MD4BUSH."' Olesker and Dresser said they had no knowledge of MD4BUSH. "Of course I'm not that guy," Olesker said in an interview. "It's not me, and I have no idea who it is." Dresser said, "I am not MD4BUSH, and I would not care to speculate who MD4BUSH might be." Finney's questions followed Freedom of Information Act requests by The Sun and other media about details of the administration's investigation into Steffen's activities. Dresser made The Sun's Freedom of Information Act request. Olesker and Dresser appear to be the only ones to have received written questions this week as part of the investigation. Finney said that he "verbally" asked other media members about MD4BUSH and intends to follow up in written form. He said the decision to question the media is part of his effort to conduct a thorough investigation into the spreading of the rumors about the mayor. "I am trying to seek information that is relevant to the governor - whether a state employee or official might be MD4BUSH," Finney said. In support of his decision to question the media, Finney cited the U.S. Court of Appeals case involving reporters Matthew Cooper of Time and Judith Miller of The New York Times, who face contempt-of-court charges for refusing to tell prosecutors about their confidential talks with an official or officials in the Bush White House who revealed the identity of a CIA operative. In that case, he said, it was suggested that there are times when it is appropriate for the media to reveal information and sources. "It's up to the newspaper whether this is one of those times," Finney said. "It's entirely appropriate for me to ask the question. If you all are going to decline to answer the question, then so be it." On Friday, the Ehrlich administration supported Finney's decision to question reporters and promised that the investigation would continue to be aggressive. "Inquiries related to the identity of MD4BUSH is part of the investigation requested by Governor Ehrlich," said Shareese N. DeLeaver, a spokeswoman for the governor. "This is intended to be a thorough investigation that will include leaving no rock unturned." Several other media organizations, including WBAL have been contacted by the governor's office, regarding MD4BUSH.
They still don't get the story right.
I find it interesting that a Google search for this handle only finds the news articles about the conspiracy and no actual posts or other references to this user name.

In the governors probe of this affair we must examine if there were others spreading these rumors. We already know of one state employee who engaged in this behavior, we must now determine if there were others.
We do not yet know if the person posting along with Mr. Steffen, with a screen name of "MD4Bush" on the web site Free Republic, is a state employee who was also involved in this scandal.
This individual's identity is fundemental in determining wether other state employees were involved as this person also spread rumors about Martin O'Malley and,in fact, did so on more occasions than Mr. Steffen. As this individual also spread rumors about Maryland Senator Barbara Mikulski, it is imperative we learn of this persons identity in order to make sure it is not part of a wider scandal.
Seems like they are going after the Sun rather than the post-sigh. Can you contact these guys and say "Hello McFly" send me a subpeana!
Look, the news about Sen. Mikulski and Brad Pitt is already out there. so there's no use in her denying it. She's a raving heterosexual and it's time she fesses up to it.

Before hand we worked on questions to ask Rumsfeld about the appalling lack of armor their vehicles going into combat have. While waiting for the VIP, I went and found the Sgt. in charge of the microphone for the question and answer session and made sure he knew to get my guys out of the crowd. So during the Q&A session, one of my guys was the second person called on. When he asked Rumsfeld why after two years here soldiers are still having to dig through trash bins to find rusted scrap metal and cracked ballistic windows for their Humvees, the place erupted in cheers so loud that Rumsfeld had to ask the guy to repeat his question. Then Rumsfeld answered something about it being "not a lack of desire or money but a logistics/physics problem." He said he recently saw about 8 of the special up-armored Humvees guarding Washington, DC, and he promised that they would no longer be used for that and that he would send them over here. Then he asked a three star general standing behind him, the commander of all ground forces here, to also answer the question. The general said it was a problem he is working on. The great part was that after the event was over the throng of national media following Rumsfeld- The New York Times, AP, all the major networks -- swarmed to the two soldiers I brought from the unit I am embedded with. Out of the 1,000 or so troops at the event there were only a handful of guys from my unit b/c the rest were too busy prepping for our trip north. The national media asked if they were the guys with the armor problem and then stuck cameras in their faces. The NY Times reporter asked me to email him the stories I had already done on it, but I said he could search for them himself on the Internet and he better not steal any of my lines. I have been trying to get this story out for weeks- as soon as I foud out I would be on an unarmored truck- and my paper published two stories on it. But it felt good to hand it off to the national press. I believe lives are at stake with so many soldiers going across the border riding with scrap metal as protection. It may be to late for the unit I am with, but hopefully not for those who come after. The press officer in charge of my regiment, the 278th, came up to me afterwords and asked if my story would be positive. I replied that I would write the truth. Then I pointed at the horde of national media pointing cameras and mics at the 278th guys and said he had bigger problems on his hands than the Chattanooga Times Free Press. This is what this job is all about - people need to know. The solider who asked the question said he felt good b/c he took his complaints to the top. When he got back to his unit most of the guys patted him on the back but a few of the officers were upset b/c they thought it would make them look bad. If you have any information that might lead to the identity of MD4BUSH, shouldn't you contact the Governor's counsel who is conducting this probe? If you are concerned about the confidentiality policies of FR, wouldn't the use of FR to carry out a public fraud and to breach the confidentiality of another, normal poster. be sufficient grounds for you to do this?
My thinking is that you have a right to do that. And, getting to the bottom of the identity of this person is an essential part of the story.

I think that's a very bad idea. While Jim might have to honor a warrant or subpoena for the information, it would be a very bad precedent to offer the information without one.
There are plenty of folks here who would take it unkindly if their identities were offered to government agencies.
I suspect Jim Robinson has no intention of offering up this information.
I would hope that if there is any legal need for learning the identity of someone on FR, the legal entity seeking such identity would go through legal channels to access the information. I would also hope that anyone posting here isn't subjected to having their names and addresses made public.
I agree with your sentiments. No reason to offer the information without being subpoenaed(sp?). Why set the precedent? Who knows who'll be coming along trolling for information after that.

You want rumors? Mayor Willie Don Schaeffer lived with his male significant other for many years. Schaeffer lived a quiet private life, no flame and pomp, and was devoted to his partner. My ex-husband, a cop, said the Balto. police regularly drove Schaeffer's gentleman around as well Schaeffer to their house.
Let's see. Well I'll throw it out there. As a child I used to help my father rig voting machines in Baltimore city. My dad and some electricians from the construction unions used to go into certain precincts and boom, just whack them with a jolt of electricity that somehow reset them.

Isn't there also a fraud exception to the attorney-client priviledge? If so, certainly there should be an exception to the confidentiality of FR posters based on fraud. on top of that, One would think that O'Malley has a defamation claim against MD4BUSH, assuming O'Malley did not cheat on his wife. A court would certainly order FR to divulge MD4BUSH's identifying information.
