Carolyn Payne Lomax was indicted Wednesday on two counts of aggravated assault in a 2004 incident at her Woodway home. Authorities said the workers were trimming trees around utility lines when the incident happened. Lomax, 63, said no one from the company contacted her before workers in her word "butchered" her trees. She said she ordered the workers to leave, but they appeared to mock her in Spanish. After repeated pleas, Lomax said she went inside, got her .22-caliber handgun, and when the workers still refused to leave, she fired two or three shots and called police. The workers told police Lomax fired at them. If convicted of the second-degree felonies, Lomax faces up to 20 years in prison. (End of Article)

I really thot this was ridiculous when I saw it. It's a case of her word against theirs. I doubt she fired directly at them as they claim. Up to a 20 year sentence is insane! Hope she hires a good lawyer.

A longtime Republican Party activist charged with shooting at workers whom she claims "butchered" trees at her Woodway home was indicted Wednesday.
Carolyn Payne Lomax, 63, was indicted on two counts of aggravated assault in a January 2004 incident in which she reportedly fired at workers for Asplundh Co. who were trimming trees around utility lines for utility company Oncor.
Lomax has said she fired the shots to get the workers off her property after repeatedly telling them to stop their work and to call a supervisor. She said no one from the company contacted her before they started trimming the trees. On previous occasions, a supervisor had come to her property and overseen the cutting when asked, she said.
This time, Lomax said, the workers appeared to be mocking her in Spanish. After repeated pleas, she said she went inside, grabbed a .22-caliber pistol from a desk drawer and headed back outside.
"I went back out in the yard and I said, 'I have a gun. Get off of my property. You're trespassing' " Lomax said. "They laughed, and they continued to cut."
Lomax said she fired two or three shots and called police to report the trespassing.
The workers told Woodway police that Lomax was shooting at them, according to reports filed in the case.
If convicted of the second-degree felonies, Lomax faces up to 20 years in prison.
Waco attorney Abel Reyna, who represents Lomax, said he was surprised by the indictment Wednesday. Reyna said he had been dealing with two assistant district attorneys about the case and neither told him that the case would be presented to the grand jury.
"Judging from the phone calls I have received in support of Mrs. Lomax, I have serious concerns as to why this assistant district attorney would seek an indictment on this particular case, especially without communicating with me first on the matter," Reyna said.
If you own land here in Texas you don't have control over the "easement" that is granted (stolen from you) to the utility and governmental agencies who use it for their own purposes such as water, sewer etc...
Look at you land plat and you will see the easement clearly outlined in the layout. "Users" of your easement have free access to that piece of land and have the "right" to do anything they see fit to do on it, anytime they wish.
You own it but you don't control it. Worse yet, you pay taxes on it and are legally liable and responsible for anything that happens on it. They don't pay you anything for it but your rates keep going up and up and up.
I won't even go into "rights of way" pertaining to other land that you must maintain but not own.
So now, you know that they can do anything they wish on your piece of property at any time they wish.
The only thing you have going for you is that they must clean up the mess they make and restore the dirt as close as possible back to it's original state. Not the trees, grass or shrubs.......just the dirt.
Tell me about "easements" - over an acre of my land is "easement" and the county wants a detailed accountiing of what "agricultural purpose" I put it to!

The cable box and telephone lines for several homes on our street and the one behind us are on a telephone pole in the back corner of our yard. After having the cable people come in the yard unannounced I gave them a little "talking to" on the telephone about the courtesies of ringing the doorbell in case they didn't want one of their men bitten by a dog. Not that I'd let the dog out there purposely when they entered ...then they'd sue me even tho they entered without permission. But the dog could BE out there when they waltz in. They were asking to come in the yard so often I finally told them no .. to bug the woman behind us for awhile. Haven't seen them since and hope I don't. They've got just as much access in her yard.
The phone company is worse. At least the cable people were apologetic and now ring our bell. Saw a phone company guy with a huge ladder putting it over the fence into the backyard. He gave me the same song and dance about their right to enter. I told him if he didn't enter somewhere else I'd let my dog show him my yard was not the only one that had access and that I was more steamed than anything that he didn't have the courtesy to ring the bell since it was obvious we were home. Haven't been bothered by him since either.
I realize they need to service their lines but don't just come waltzing on my property without the courtesy of letting me know you're coming for a "visit." I might need to put "killer" away .. ha.. not her real name. She's more scared than them but she has a good style that will deter intruders.

It goes back to the first few post. Someone called him on it when they notice he/she posted only articles of one writer. The mod had to claim things down. Not many times the mod has to break up the thread of a newbie who still has privileges.

Go to the county courthouse and find the easement document filed for record.
In it, you will find what rights and obligations the owner of the easement has to you. I'd be shocked if they have to contact you in advance.

I'm sure you're correct. We thot of putting a "Beware of Dog" sign on the gate to PROTECT ourselves (from lawsuits)! At least that might deter someone from coming during the day when no one is home tho our dogs are strictly indoor. But it might deter someone from entering while we ARE at home who didn't have the *intelligence,* *forethought,* and/or *courtesy* after seeing the sign to ring the bell to see if anyone is home and if there is a "killer" dog in the backyard. What scared us so much is the recent incident when the dogs had just come back in and less than five minutes later someone did enter the yard unannounced. Had he done that when the dogs are out there's a chance he would have been bitten by one who can be fear aggressive. Then WE'D get sued.
Thot of a lock and chain on the gate but that would be a hassle since we use the gate so much.
