Sub shop robbery attempt torpedoed

Manager wounds masked man who had a gun

DAYTON | A robbery suspect was shot in the arm Friday by the manager of the Subway restaurant he is accused of trying to rob in the 2800 block of East Third Street, Dayton police said.

The suspect, whose name was not released, was taken to a local hospital to be treated for the non-life-threatening wound after police caught up with him at his sister's house in the 1-99 block of Philadelphia Street shortly after 1 p.m., police said.

A 26-year-old Dayton man, an employee of the Subway who asked not to be identified by name, said he was on the telephone behind the counter when he looked out the window and saw a man coming from the side of the building, wearing a mask and sunglasses.

Just before the suspect walked in, the employee said, the wife of the sub shop manager activated the security system and told her husband she thought they were about to be robbed. She, too, had noticed the masked man, the employee said.

"Next thing you know (the suspect) got up on the counter," the employee said. "I was scared. I just dropped to the floor."

The suspect pointed a weapon at the manager, who was counting money, the employee said.

Unbeknownst to the suspect, the manager was carrying a gun, said the employee who noted that the sandwich shop had been robbed just before the holidays.

"My boss fired at him. ? (The suspect) didn't even have a chance to talk," the employee said.

The manager fired a 9 mm at the suspect, who was holding a .22 caliber handgun, Dayton Sgt. Michael McCune said. The suspect dropped his gun and ran out the front door to his sister's house, a block away from the restaurant. The sister called 911, police said.

There were as many as seven people in the eatery when the incident occurred, said Anita Wagner, who saw the suspect running from store just before she entered on her lunch break.

The suspect, who McCune said is on parole, is likely to be charged with aggravated robbery when the hospital releases him to police custody.

The manager, whose name was not released, was not cited, McCune said.

The name probably wasn't released because the suspect is a juvanile. I find it hysterical the guy went in expecting some easy cash and wound up shot by a gun a lot bigger than his and his sister had to call an ambulance for him. Dumb crook of the month runner-up

Yea...how can we be sure of "criminal intent." Just having on a ski mask, sunglasses and carrying a handgun doesn't mean he actually intended to rob the place. I can just hear the defense attorneys now...

I a lot of places, mainly blue states, they would probably
arrest the manager, and let the perp walk.
