A federal judge in Washington has upheld the right of the American military to place its personnel under United Nations command and force those soldiers to wear insignia designed by the world body.
The ruling from Judge Paul Friedman came in the case of a former Army specialist, Michael New, who resisted orders that he serve in a U.N. peacekeeping mission in Macedonia nearly a decade ago. He also refused, during unit muster in 1995, to wear the light blue U.N. cap and shoulder patch.
Mr. New was court-martialed for failing to obey the order to don the cap and patch. He was convicted in 1996 and given a "bad conduct" discharge from the Army. Military appeals courts upheld the decision.
In his 35-page decision filed Wednesday, Judge Friedman rejected all of the legal arguments put forth by Mr. New's attorneys. The judge said most of the ex-soldier's assertions involved thorny political disputes best left unresolved by the judiciary.
Judge Friedman wrote that trying to sort out whether the president had ceded too much authority to foreign military officers "would involve policy determinations beyond the competence of the court."
Mr. New could not be reached for comment yesterday. His father, Daniel, said his son was in Germany for the holidays.
"We're disappointed," Daniel New said. "It's not printable what I want to say." He added that an appeal is likely.
A spokesman for the Pentagon said no one was available yesterday to comment on the decision.

At the close of our range sessions, it is traditional to end with a "mad minute" -- wherein eveyone loads up whatever they brought, and, on command, unloads it into a single target. One of our most memorable minutes was when one of our group who had just returned from UN -controlled "peacekeeping" service in Macedonia offered his UN blue beret as our "MM" target...
There is no doubt as to what that particular soldier thought about the subject of this thread!

We live in a different world these days. I would love to see the UN fade away into oblivion, but that is not a priority for the Bush administration.

New did the right thing--he said 'no'.
Would that the rest of us WHEN not if, we run into conflict with the new world order refuse as well to be backed over our line.
His superiors could just as well have ordered New, in his OWN uniform to complete a certain mission in support of the UN but they didn't. They ordered him to wear a uniform that was NOT the uniform of his country.

The President has said that our troops will not go anywhere that they fall under the international court. If they were under un command they would be subject to international treaty. The un is so over.

Im glad I retired before this became an issue. Hopefully it will be resolved before more American Military personnel are forces to wear the uniform of a foreign government.

I won't even wear that black one except with my Class A's. It is bull$hit they took away the Ranger's beret (which they sweat blood and lose 1/3 of their body weight on average) to earn and gave it to the rest of the Army. I wear my soft cap and that's it.
It would be one very cold day in hell before I wear a blue beret or a blue Kevlar cover.
