Woman who drowned kids appeals conviction (Andrea Yates)

HOUSTON (AP) - Andrea Yates' murder convictions for drowning her children should be overturned because the state's expert witness gave false testimony about working on an episode of "Law and Order," her attorneys told a state appeals court Tuesday.

Yates was sentenced to life in prison in the 2001 deaths of three of her children after jurors rejected her insanity defense. She was not tried in the deaths of the other two.

Psychiatrists testified that Yates suffered from schizophrenia and postpartum depression.

Her attorneys told a three-judge panel of the state's First Court of Appeals that she deserves a new trial because of 19 errors that were committed in her 2002 trial.

I think you have Andrea Yates confused with Susan Smith, who drowned her two young boys in her car.

Andrea Yates is the monster who drowned her five little children, one by one, in the bathtub.

If they do retry her, is it possible that the nasty scank will get what she deserves- the death penalty? If that is a strong possibility then I'm all for retrying that @#$$%#$# waste of human tissue.

She isn't going anywhere but the Skyview Unit in Rusk, Texas. Texans don't execute people that are insane.

Why is it that of all the people on death row, only Timothy McVeigh actually had his sentence carried out within 4 years, while everyone else takes 20?

No she was not found insane... she was found GUILTY of murder. The jury chose to give her life instead of the death penalty.

And just WHY does she? My mother was her nurse until last August at the Prison Unit in Rusk, and has told me that there wasn't a doubt in her mind that this lady was totally insane. Once she was stabalized on medication for three months and realized what she had done, she has been on CONSTANT 24 hour suicide watch. She can't live with herself. Now don't get me wrong, the crime was horrible, and I believe in the Death Penalty, but not for people ruled insane.

I stand corrected, but the reason the jury chose life was due to her obvious insanity. She has a serious mental condition.

Although prosecutors acknowledged Yates was mentally ill, the jury decided she knew her actions were wrong.

Because they wanted him to shut up asap. I think McVeigh could have caused some problems if he really decided to spill the beans.

unfortunately Rusty yeates was not convicted right along with her. Relax folks, she is not getting out of prison.

Matter of fact she's in prison about 40 miles from my home.......(maybe Santa will bring me that howitzer i asked for Christmas)

You see the thing is he wasn't just as nutty as she, and that it why I hold him more morally responsible for these murders that I hold Andrea. However, her history of severe mental illness was so well-documented, as was the husband's knowledge of it, that I don't understand why he wasn't also tried for some crime. Negligence, depraved indifference, child endangerment, whatever Tx law provides for.

Oh yes, thanks for clearing that up for me. I did have them mixed up. However, they are both MONSTERS of the worst sort and hope they stay in jail. those beautiful little children being killed by the one person in their lives who should have been protecting them from any and all dangers. Instead, those mothers betrayed thier babies. God forgive them.
