Ohio Presidential Votes to Be Challenged in State Supreme Count

Ohio's 2004 Presidential vote will be challenged as soon as next week in the state's Supreme Court, a coalition of public interest lawyers announced Friday.

The Lawyers have sworn testimony from hundereds of people in hearings in Columbus and Cincinnati, and will use excerpts as well as documents obtained from county election officials to make a case that thousands of votes were incorrectly counted or not counted on Election Day.

Ohio Secretary of State Ken Blackwell has not yet certified the November 2nd vote.

State election law says an election challenge must show that the wrong candidate has been declared the winner, or it can be dismissed without a hearing.

The state Supreme Court Chief Justice will hear the case.

The Ohio Republican party publicly dismissed the challenge on Friday, according to the Associated Press, but the coaltion announcing it said they were ready to litigate.

The judge is a Republican. They also haven't finished counting so this case is moot.

I hope they keep pushing it. If the Dems try to accuse us of fraud, they'll only end up exposing their own attempts to steal this election for all to see.

Even if they fail, the challenge itself gives them a talking point for the uninformed for the next four years.

Will they wait until the count is complete and then sue?

Doesn't matter though, becuase the Ohio State Chief Justice is GOP, is this a setup to go to more liberal federal district court under supposed 'violations' of the Voting Right Acts?

I think this may be a setup to go to Federal appeals court after the case is denied and shop around for a liberal panel of justices to hear the case..

Anyhow, you cannot count votes that never existed.
