I think that argument depends on the seriousness of the crime. Simple possesion of marajuana vs. intenet to distribute tons of drugs, should be taken into consideration.

Take out the hysterical, revenue driven, MADD inspired, craven road block mentality for DWI arrests and that number (those on probation) would drop 20 fold. So technically that is "crime" but of a very different nature than the headline presents.
