NCSU Freshman Accused Of Downloading Child Porn

[Summary: A warrant for arrest has been issued for, Wesley Mincey, an eighteen-year-old freshman at NCSC. The warrant was issued following a call to police from his roommate, who had borrowed Mincey's computer. While using the computer, the roommate discovered that Mincey had downloaded child pornography.]

Yeah. I'm sure his trip to Thailand was going to be purely benign.

You are correct that there could be a relatively innocent explanation, at least in theory. But I've run into a couple of real-world cases of these guys and believe me, it wasn't borderline. If it's a single file, a single time, then that's one thing. If it's several thousand files over a period of weeks, (which is not at all uncommon) then I'd say our young friend will be needing a lawyer...and some counseling.

I think you're correct in advising that we wait for that sort of information before hanging him.

All your vaunted legalism is wonderful, but let's examine the case where there is a simple and innocent explanation for this. You pick the explanation, but just suppose for the moment that the kid is not guilty of knowingly soliciting or acquiring child pornography.

So the jury acquits him. Wonderful. His record is now clean. However, he now lives squarely in one of the inner circles of Hell. His picture has been published in the newspaper. He might as well quit school because he is thoroughly screwed there. No one will have a thing to do with him. These things have a way of following you around. Even if he moves somewhere else, it is unlikely he will ever escape this. There is no chance anyone will ever trust him around children. It is not hard to picture the situation where he is harassed for the rest of his life by the Child Protection Nazis who frequent local governments.

Great. All your legalism, both biblical and civil, have left you with a clean conscience, but this kid, if he is innocent, faces a life of misery and pain.

I think you might have missed the point of the passage from Matthew, my friend. I know you have missed the point of the Fourth Amendment. What a shame.

You've got me. I don't share your liberal tolerance for this kind of behavior (and, by the way, all of you defenders of the 4th Amendment - there WAS a search warrant):

Neither of us condoned the behavior. We simply stated that perhaps you ought to wait for the fair trial before proceeding directly to the hanging. I'm sure you would appreciate the same consideration. Hopefully, you'll never have to find out firsthand.

Dittoes; there is no explanation that can be accepted supportive of child pornography! None. It is a crime, and there is nothing minor about it.

No-one is supportive of child pornography. That is a disgusting.

The point I was trying to make is that we can't leap to judgement about someone's guilt or innocence.

Re-read my posts #72, 77, and 84 and tell me how you can twist any of those posts into the conclusion that I oppose a fair trial. I'll give you some more help, here is the closest quote you are likely to find: "If I was on a jury, I'd make the state prove that the stuff was there, and that he was the one who put it there before I'd convict."

Someone put the photos on there, and as I said in 84, I have not your tolerance of that sort of behavior (whether committed by the defendant or by another person). As for your comments about my Biblical (Christians capitalize that word) legalilsm, perhaps you are just reacting because the accused wasn't warned in time to destroy the evidence. And as for the 4th Amendment, I seem to have a better grasp of the plain language and judicial interpretations than do you.

I'll accept your subsequent comments (to your initial one) and suggest that my first post to you might have been a little harsh (but justified). He deserves a fair trial, but he is going to have an uphill battle. He better be prepared to take the stand with a good story. I still submit this isn't something that could be taken to the church fathers for resolution.
