New Supreme Court Nominees?

It looks like Bush will get the chance to nominate hopefully at least a couple of SCOTUS justices. Does the Daschle loss break the filibuster? Even if not, I don't think the Rats can sustain a filibuster of a SCOTUS nominee.

I would like to see Estrada renominated for the Court of Appeals, if not SCOTUS. Justice Janice Rogers Brown would be a tremendous nominee as well.

I would love a Chief Justice Scalia, but that would be a battle. So be it, IMO.

I hope Bush renominates all of the filibustered judges, especially Estrada.

When the new Senate comes into session, it must vote to reaffirm or change the rules by which it will function. It is not bound by the operational rules of the prior Senate. The Rules Committee chairman can propose a new rule to limit the application of a filibuster to judicial nominations (or to change the requirements for invoking cloture). Such a proposed rule change cannot be filibustered. The Vice President, exercising his constitutional power as Senate president can rule any attempt to filibuster such a vote on a rule out of order. To pass such a rule would simply require a majority vote. And, if the vote were tied, the Vice President, again exercising his constitutional power could cast the deciding vote. However, the real problem is getting enough Republican senators to vote for the rule change.

Bork is too liberal.

I want Bush to appoint someone who will make Scalia look liberal.

I want a conservative who will never "grow in office" an wind up as a lib or moderate.

Ethnically I believe you're right. It is almost certain the prez will nominate a hispanic to SCOTUS.

The truly weird thing is that the GOP Majority may put the liberal Arlen Specter in charge of the Judiciary and the Democrat Minority Leader may be the nominally pro-life Democrat Reid.

Good idea! I would re-nominate Bork just to wear these Bastards out in hearings before re-nominating or nominating new candidates.

Bork would have to go along with this plan.

That plus GOP gains in the Sen and House and Bush's majority pop vote. The Dems will scream and screech but in the end they will have to let the judges to go a vote.

I think Specter will be line this time around. He got a huge primary scare and survived it only because Bush went to bat for him. AT least I hope it is so.
