INTERVENTION TO HEAD OFF ELECTION LOSS

DASCHLE LAWYERS GO TO FEDERAL COURT AT 8:00 PM TONIGHT TO STEAL VOTES, ELIMINATE REPUBLICAN POLL WATCHERS

SIOUX FALLS – Anticipating a loss to Republican challenger John Thune tomorrow ending his 26-year congressional career, Senator Tom Daschle will seek federal judicial intervention in the election process tonight, Monday, November 1 during an emergency hearing in federal court in Sioux Falls at 8:00 PM.

The hearing will be before Federal Judge Larry Piersol who was appointed by Daschle to federal court and served as Daschle’s personal legal counsel in 1978.

“This is nothing short of an attempt to steal an election Tom Daschle knows he is about to lose tomorrow,” said Thune for Senate campaign manager Dick Wadhams. “Daschle’s goon lawyers will seek to get Republican poll watchers removed from reservations and for voters to lose their right to vote.”

Lawyers representing Tom Daschle successfully called for the hearing tonight in front of Daschle-appointed Judge Piersol.

The Pennington County Auditor was informed earlier today that Daschle lawyers will seek to ban the counting of legitimate absentee ballot requests in Pennington County tomorrow, Election Day, morning.

Its times like this that shows the importance of keeping Bush in White House when there are up to 4 openings possible in Supreme Court. Could you imagine Daschle having final say over who would go in? Like Hilary maybe?

Can you say corruption that would make the UN Oil-for-food program look like childs play?

I agree. And not only is it something that could happen, it is something that should happen if we are faced with no other option. It seems little Tommy wants to ensure that we are left with no other option.

Obviously, this is a move of EXTREME DESPERATION for Daschle. Daschle does get much support from independents and republicans. That's the only way he can get elected in SD.

This could well sink him to the point where the reservation vote will be irrelevant. He must have really been trailing.

I should say that I think the vast majority of federal judges, appointed by Republicans or Democrats, always try to apply the law fairly and without prejudice. That said, I think most federal judges would recuse themselves in circumstances similar to those found here. Whether Piersol should be recused from Dashle’s case is an issue that only Piersol will be able to consider in the short period of time. And if he issues an order barring Republican poll watchers from the polls, it probably can’t be reviewed until after the election. So while the law may not be on Daschle’s side, the “Law” may yet be in his corner. And even if Piersol does issue a conscientious decision in the case, it doesn’t change the fact that Daschle pulled a rather questionable move by even bringing the case in Piersol’s court in the first place.

Update at Daschle vs. Thune:
UPDATE: Daschle rests. Cancels other witness because first one got destroyed. Dismissal requested by Republicans. Dismissal denied.

UPDATE: Thune campaign manager Dick Wadhams just gave a blistering interview to KSFY Television. 190 people outside courthouse in pro-Thune flash mob, including Sen. Jim Abdnor, who came down and said "we need voters to decide this race not judges."

UPDATE: So apparently Daschle couldn't find anyone to say there were "intimidated" so they dragged in a Howard Dean supporter from Virginia who worked in Iowa who has been in South Dakota a day to complain about faces being made.

Something is being "heard" at the courthouse right now. If a judge "recuses" himself, would he do it after initial arguments or before he'd even start listening?

I understand that Daschle wants poll watchers banned because they make faces,(instead of sitting there like wooden Indians (sorry, could not help myself)), but what is his argument in court tonight for wanting to ban legitimate absentee ballot counting?

I don't think so - I'm sure Kerry is probably happy because this would just set him up to use as an example of the Republicans trying "anything they can" to win. Even though Daschle is the one to bring the lawsuit, fact like that never gets in the way of a good democratic whine.
