A commerical vehicle is any over 10,000lbs VGW or vehicle gross weight. These vehicles are subject to regulation by the Dept. of Transportation and operate effectively under the Interstate Commerce clause of the US Constitution.

Blood of Tyrants, funny you mentioned FDR. We have one of his fans with us today!

Smartaleck, the Interstate Commerce Clause does not override other parts of the Constitution. It was intened to keep states from levying tariffs against each other, that is of course unless you're a FDR/Al Gore style "living Constitution" liberal.

Even if the ICC gave Congress the authority to search commercial vehicles at will (it doesn't), the 4th Amendment amended the Constitution, and would have taken that power away.

Amendment IV:
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

I don't see exceptions for gross weight or commercial vehicles in there, do you?

The "entitlement mentality" of some USofAmericans astounds me. I want to shout: GET A JOB! And at employERS I want to shout: Provide affordable health insurance! (I live in a small County in Appalachia and health insurance from employers is nearly nonexistent.

They aren't searching people, they're searching commercial enterprises. The law regarding interstate commerce is long and well documented.....and is....as a result of due process.

No, you invoked his (oh yes it is very much his) twisted, contorted living Constitution version of the ICC. You know, the same version that released the federal government from the limitations of Article I, Section 8 and gave them a blank check to do whatever they damned well please, thus turning the design of the Republic on its head.

This is a very serious effort and has a very serious reason for backing up major interstate traffic. Cut the crap postings on this ... I live in E. TN and do have a few law enforcement friends and I don't appreciate your crap or your dismissal of this very serious action in progress.

Sure, Police routinely seize the property of innocent Americans in a total violation of the Bill of Rights. As was recently reported here on FR how the Tampa, Fl. cops use seized cars & trucks, Bucs tickets and cash for personal use. I used to have tremendous respect for cops as they do have a very tough job under difficult situations but no more. If even one of them does this it makes them all guilty for not standing up and screaming that this is wrong. Cops do not have the right to violate the Bill of Rights for their own personal use. Period.

As a result all cops are corrupt thugs, nothing more. Or they would do the honorable thing and denounce this as what it is. Socialism. IMHO.
