"Consequently, if a Catholic publicly and obstinately supports the civil right to abortion, knowing that the Church teaches officially against that legislation, he or she commits that heresy envisioned by Can. 751 of the Code. Provided that the presumptions of knowledge of the law and penalty (Can. 15, s. 2) and imputability (Can. 1321, s. 3) are not rebutted in the external forum, one is automatically excommunicated according to Can. 1364, s. 1."
Rome has spoken, the matter is nearly closed. As those who obtain their news from sources other than the MSM know, a canon lawyer, a lay person, initiated a formal charge of heresy against Senator Kerry in the spring of this year. For having the hubris to do so, he was fired from his job by Cardinal Mahoney of Los Angeles, who is apparently not averse to profaning the Eucharist as long as the political situation is not disturbed. In August, the lawyer in question took his case to Rome, proposing two formal dubiums (questions). The paragraph above is Rome's official response.

Catholic ping time.
HERESY! WOO OOO! Are they gonna burn him?
Which is a pity, given that Senator Kennedy is next on the docket and anything that is more than 50% alcohol always produces a good flame.
Can. 15, s. 2 - Can. 15 §1. Ignorance or error about invalidating or disqualifying laws does not impede their effect unless it is expressly established otherwise.
§2. Ignorance or error about a law, a penalty, a fact concerning oneself, or a notorious fact concerning another is not presumed; it is presumed about a fact concerning another which is not notorious until the contrary is proven.
Can. 1321, s. 3 - PENAL SANCTIONS (Cann. 1321 - 1330) Can. 1321 §1. No one is punished unless the external violation of a law or precept, committed by the person, is gravely imputable by reason of malice or negligence.
§2. A penalty established by a law or precept binds the person who has deliberately violated the law or precept; however, a person who violated a law or precept by omitting necessary diligence is not punished unless the law or precept provides otherwise.
§3. When an external violation has occurred, imputability is presumed unless it is otherwise apparent.

"Sadly, burning is no longer one of the canonical penalties.

True....we could have roasted wienies for Ramadan at his pyre.....
"Bloggers & Personal"
Go figure. This was front page stuff when I saw it.
So now what? Where is this all headed? Will there be an official statement from the Church at some point?
Thanks for writing the original article, thanks for posting.
If you are not the lay person referred to in the article, is that person's name being withheld in the name of that person's safety, or simply a wish to stay out of the secular spotlight?
If YOU are the lay person, nice job. I had no idea a lay person could do the end-around.
If Kerry WERE, heaven forbid, elected, the apparently inevitable recognition of the excommunication and public denial of Communion would IMHO set off a state-religion civil and legal battle like we've never seen before in this country. With many of the levers of power in place, The Left would have a 50-50 chance of silencing public religious-based criticism.
Thank goodness, at least at this moment, that it appears unlikely.
What is still sad is that Kerry will probably get about half the Catholic vote.
Nearly? It was nearly 20 years ago.
Today, I was having a conversation after Mass with a friend. We were discussing the changes to the Mass. Placing the Host in your mouth at the altar, bowing at the appropriate times and standing during one of the prayers. I remarked that I could see the part with the Host. This person went off about faith is between you and God and no one else. How people who objected to some of the sacriledge that goes on were just trying to pass judgement those committing the offenses. Blah, blah, blah. Faith is deeper than other people's judgements. I could but stare.... This person would lean over and get in my face and say that people who thought certain behaviors were required were wrong and didn't get faith.
Pop quiz: Who will that person be voting for on Nov 2?
Sometimes, I'm quite surprised by people who say they are Catholic.
I'm watching the Cardinals-Astros game, and lo and behold, the John Kerry "I'm a Catholic... I was an altar boy... faith and works, etc. etc...." ad has just aired. Had to change the channel.
I just can't figure out why he's airing it here in California.
I was under the impression he was far ahead here in the polls. They're running scared, IMO.
Bumpity bump!
No! This is an example of 'latae sentiae' excommunication. The church cannot tell you how to vote. According to Canon Law, Kerry has excommunicated himself. It is up to you, the voter, to understand this situation and vote accordingly.
I was so mad. O'Reilly asked if it was sinful to vote for a politician who backs abortion. Fr. Pavone said it was, the americhurch priest said it wasn't.
But isn't any priest who knows of this 'latae sentiae' excommunication AUTOMATICALLY prohibited from giving him Communion in the absence of public repudiation of his current antilife positions (including Embryonic SCR)?
If he does administer Communion anyway, isn't the priest at risk of being defrocked?
And if the Bishops won't initiate the action, can a lay person do an end-around to defrock the priest?
Paging Herman the Cherusker for possible assistance.
All of us need to diseminate this far and wide. All of us. ASAP.
Sadly, poor catechesis has resulted in this situation; that, combined with poor homiletics from many wishy washy priests.
Earlier this year, I watched helplessly as a Eucharistic Minister dropped a consecrated host on the floor, looked towards the pastor for guidance, received none, bent over, picked up the errant host, and redeposited it into her Pyres glass salad communion bowl. I buried my head in my hands, pleaded with our Lord to forgive her ignorance and also asked him to lead me to a "holy man, a valid liturgy and a welcoming community".
That journey began the following weekend, when I compiled a list of other RC parishes within my community. Thanks to a fellow freeper, I also included two Eastern Catholic Rite Churches. After several weeks of attending Mass at other RC parishes, the Maronite Catholic (Eastern Rite) Church surfaced on my list.
The Consecration was in Aramaic, using the language and words of our Lord at the Last Supper. Communion was by intinction - ONLY the priest distributes communion. It is dipped into the Precious Blood and placed on the tongue of the communicant with the words: "Receive the Body and Blood of our Lord, Jesus Christ, for the remission of sin and eternal salvation."
It has now been 7 months since I joined that parish. As a Roman Catholic, we are entitled to attend any of the 22 different liturgies that make up the Holy Catholic Church. The Eastern Catholic Rites retain the sanctity of the Holy Eucharist. I would urge you to explore your local community to seek out an Eastern Rite Catholic Church. You will find a listing by state at this link.
