I'm not up on military law. Does the person have to be on active duty? They said Kerry was on reserve duty and it was OK -- sounds like a lot of nonsense to me.

At the top of the hour WABC news, they played a clip of Kerry saying to vets today that Bush has not been telling the truth about Iraq and that each day is met with more chaos and INDISCRIMINATE killing.
Yes, he said indiscriminate killing. What the h*ll does that mean?

There are several issues that need to be raised relative to Kerry's Reserve status. Kerry met with the Vietnamese Communists in Paris, per his sworn testimony before the Senate, while still being a member of the Naval Reserves subject to recall. He returned and advocated acceptance of the Communists' negotiating points. Kerry also participated in the VVAW as a national officer and was involved in the infamous Kansas City meeting where discussions were held about assassinating USG officials.

The question is whether Kerry was violating the UCMJ or federal statute by being involved in these activities while still serving in the Reserves and being subject to recall. What I found curious on Kerry's initial website many months ago was the fact that he listed his military service as 1966-1970-Active Duty and 1972-78-Reserves. He conveniently left a gap between 1970-72, which I can only believe was done intentionally so as not to raise questions. Currently, his service timeline no longer includes his reserve service. Curiously, it ends with the following: April 29, 1970 Kerry listed as Registrant who has completed service. John Kerry for President - John Kerry's Vietnam Service Timeline

I understand that the classification Registrant means that Kerry was no longer in a draft eligible status. Kerry remained a member of the inactive Reserves until he was transferred into the Standby Reserves on July 1, 1972. This could be a smokescreen to inoculate Kerry from charges that he was giving aid and comfort to the enemy while still being a member of the Reserves. We definitely need more information on this one.

John O'Niell points that out too - how Kerry took the reference out of his website "served until 1970. Afterwards, Kerry continued his military service in the United States Navel Reserves from 1972 through 1978." What about 1971?

Why does anyone expect this to get play other than on Fox? Clinton did the same thing, only he went into then Soviet Union and met with them in private meetings. He managed to keep it from the mainstream public for eight years (or longer).

If Kerry even so much as contacted agents of a hostile government while either in active or Reserve status, either would have been a violation of the Unformed Code of Military Justice and punishable under United States Code. There is a statute of limitations, but it would not have run out in the decade from 1970 to 1980 when Kerry reverted from active to Reserve status.

However, the statute of limitations is more than likely run out, leaving Kerry immune to punitive actions under United States Code.

Now all somebody has to do is prove he violated the UCMJ by collaborating with Chinese Communist agents while either in active or Reserve status.

In order for Kerry to be subject to the UCMJ, he would have to be recalled to active duty to be prosecuted.
