I wonder in the coming days, if the MSM will mention the scarcity of Kerry engagements...that his phone calls aren't returned, and that he's considered poison on the campaign trail, etc..?

When have you EVER seen a Democrat do Time? They are ALL crooked. (Name one who can tell the truth, who wont adopt and "ends justify the means" strategy, who wont rig an election. Go ahead, name one.)
I think they make them do time if they find out they are honest (at that point however, the Dims have immediately pulled their party affiliations, anyway.)

The thing is this, to me: CBS continues, as of its Saturday evening newscast, to imply that the "documents" are official US government documents pertaining to Bush's service. They are not; whatever else they may be, they are not official US government documents.

Rather can't back down. Deception does not have first amendment protection. The producer of the forgeries will not be protected. Under any standard of law, a lie does not get first amendment protection.

Oh yes they do. They pretty much have virtual cover. Read Anderson vs. Liberty Lobby, re-read NY Times vs. Sullivan. There's no way they'd be liable no matter how deceptive they were, no matter how much their producers or Rather might have known. There are just too many loopholes. I have seen only one case in which they (almost, barely) lost and it is not on point for these set of facts.

I'm telling you the media is out of control and these AWFUL decisions are why.

The producer of the forgeries, correct, do not have 1st Am. protection but CBS will never give up thier sources and the only parties who have standing are not going to sue.

Look at it this way, those who have standing to sue:

The FCC
The Killian Family
George W. Bush

That's about it. The Killians can bring a civil suit for defamation, slander but you cant slander the dead and it's a non starter anyway. They can go for intentional or negligent infliction of emotional distress but intentional wont make it and negligent, you have to show damages. Real damages. (Severe emotional distress, hospitalizations, damage to repuation, business loss, that sort of thing.) The fact that the family had a public forum to refute the charges might mitigate against any damages.

The Bushes are out, they are public figures and DONT want to open that can of worms.

The FCC would look partisan (especially after using Nipplegate to DISTRACT ATTENTION AWAY FROM IRAQ. lol. sorry, had to get that in.)

CBS could sue but that would mean they were taken for fools. How likely is that? None. No way. Not happening. So, who's going to sue? Me, you? I wish the law afforded us such protection against the Dan Rathers of the world but it don't.

Now that is a possibility I hadn't considered. But isnt that usually used for material misrepresentations say in a civil or criminal action, or falsifying records for official purposes. To use that law to prosecute the "Forger" for political ends, I dont know. I mean if someone was harmed but really, was the government harmed? I mean principle has been thrown out the window a long time ago but this is almost at this point a joke. Do you think the FBI would activate this law to get at this joker when most of the feds probably think these Forgeries are the best thing that ever happened to them since Monica Lewinsky saved them from Clinton? (His being distracted had to have saved the FBI agents from biting their nails over trying to keep track of all the traitors in that Animal House.) JMO, would love to hear your thoughts.

Good find on that law.

Well I mean over the whole spectrum of the media, including news channels as well as other types. FOX news is to PBS what the History Channel is to Comedy Central. My opinion is that bias obviously exists from station to station, but if you were to look at the media as a whole, you'd find that for biased viewpoint, there is an equal and opposite bias somewhere else. The media represents us in the end, and I think its safe to say its just as divided as everyone else is....right down the center.

Dan Rather, the DNC and Kerry are all equal partners in the liberal lie, and because they control the MSM and to a large extent the courts, liberals have gotten away with saying and doing what they please for years with arrogant impunity. But I don't think that it's dreaming to think that Rathergate will turn the tide and that the perps of this scam will become known and will meet justice. This story has legs, unhoped for legs. Up till now, Dan Rather was the King of Broadcast Journalism. But now Dan Rather has been revealed as nothing but a foolish old man who made disastrous mistake in sticking with his story. His colleagues in the MSM are circling like sharks that have tasted blood, and when, perhaps as of next week, the facts come out and Dan loses credibility, all the liberals lose credibility. If, as Pat Caddell supposes, Dan Rather falls, they all fall. Game over, dude. The brilliant research here on FR has shown clearly that the TXANG records are forgeries. Now it's time for the FBI to investigate and haul the forgers' a$$es into court.

We mustn't be like Charlie Brown and try to kick that football. Remember Sandy Berger? Remember clinton's Chinese connection? Remember every time we thought that justice would be meeted out to the rats?

No, this will discredit the rats, but nobody will be prosecuted, unless it was a Republican set-up. Then there will be many investigations and perhaps a conviction or two (in a D.C. court)of Republicans.

CBS will stick to this story, and maybe some other networks will continue to cover it straight, but the wire services and most rat newspapers will probably side with Rather.

Not necessarily. The Republicans could have set them up, a possibility I find highly amusing. The Republicans probably were able to identify the rat mole in the Pentagon who forwarded the Abu Grabe photos to the rats. I believe they went through Seymore Hersch. They could have produced the forgeries and allowed the mole to 'steal' them. At least that's what I would have done.

Maybe that clever Republican slipped them into the National Archives, and they wound up in Sandy Berger's socks.

That's a really good point. Additionally, what you rarely hear from the Democrats is discussion of an issue which is based on principles and not creating coalitions of voters or playing to the lowest common denominator. It's always about how bad the Republicans are or how much largesse they are going to give some particular group.

I hope you're right cloud. No one more than me hopes you are right but I've been in the media and legal profession for too long to have any illusions.

Who knows, maybe this is the tipping point but I've seen too many outrages like this come and go. You have no idea what you're up against, the duplicity, the utter entrenchment of these malevolents. I've seen it for too long but hope springs eternal and I pray you are right!
