RALEIGH, N.C. -- Former U.S. Rep. Frank Ballance was indicted Thursday on a federal charge of mail fraud and money laundering.
The U.S. Attorney's Office in Raleigh said Ballance and his son, Garey Ballance, both face charges in connection with a drug and alcohol counseling program the father founded in northeastern North Carolina.
Garey Ballance, a District Court judge, is charged with not filing a tax return in 2000.
Ballance, 62, resigned from Congress in June, four months after being diagnosed with myasthenia gravis, a condition that results in muscle weakness.
Meanwhile, federal and state investigators were probing the activities of the foundation, which was the subject of a stinging state audit last fall.
The state found that the John A. Hyman Foundation was riddled with conflicts of interest and had made $325,000 in questionable payments. The foundation has received $2.1 million in state money since 1994, thanks in part to Ballance, a longtime state representative who chaired the organization's board.
Ballance was elected to the U.S. House in 2002, after former Rep. Eva Clayton retired from the seat she had held for a decade.
He initially filed for re-election this year, then withdrew in May, citing his medical condition.
In June he resigned from Congress, saying his condition had worsened. Democrat G.K. Butterfield won a special election in July to fill the remainder of Ballance's term, and is the Democratic candidate for the general election in November.

I am assuming he is a demoncrat, because if he were a Republican the article would have pointed that out several times (as in "Republican Congressman Charged"....Ballance, a Republican, is accused of....the Republican withdrew from the race....") But it wouldn't look so good for corruption to be directly linked to a dem, so he only gets identified by him name and his party is ignored.
